I got a call from Amber with Highland Group, a "3rd party lender" to verify loan application information.  According to Amber, they are located in the Midwest, but don't have an address or a website.  They buy their leads from 'undisclosed locations'.  I talked to her manager "Joe" and he said that they are located in Charlestown on the island of Nevis in the West Indies (Caribbean). They seem like a small operation, but something isn't lining up.

I dont understand. I filld out an app and everything went smooth. I contacted them looking for a loan. Yea they might call alot but i assure you its only to let you know that they are real and its not a scam. Dispite where thier located. I had my loan money the same day. To me it seems like as long as you have the funds to pay the payments on it everything should go smooth.

I have a current loan with them and have not had any issues until now.  They have not debited the last two payments on the due date and this is the email I have received three times in the last two weeks:

    Dear Valued Customer,

Unfortunately we are experiencing technical difficulties with our bank and will not be able to process payments for your upcoming due date. The charges due will be pulled from your account early next week. If you would like to pay over the phone using a credit or debit card you may give us a call. Your payment will be processed ASAP please make sure the funds are available.

    Best Regards,

So today I call them to ask what the heck is going on!..and they offer me a real cheesy deal to pay the loan in full - waiving all finance charges, etc.  They also said that I have to use a debit or prepaid debit to do this because their "ACH processor is down".  Anybody know what's going on? - have they been oerating illegally or going under or something?

this company is one of the payday loan companies that recently came under scrutiny by the New York Attorney General, they've been blocked from accessing the ACH network (and thus customer bank accounts) so now the company is clearly scrambling to try to get people to pay via debit/credit card before they go under.

I contacted a quick pay day loan, but I told them I didn't need the loan any more so they canceled my application. Two days later I received a deposit from Highland Group into my checking account. I never heard of nor did I speak to anyone from Highland group. I did not give them my banking info nor did I athorized them to deposit money. A few weeks later I get a call that I am getting sued by Highland group and they are going to contact my job of fraudulent activity. I have always lived a respectable life, I have never experienced anything like this. I don't mind paying them the money back that I never approved them to deposit, but I feel violated because they had access to my bank info without my consent. How can we get rid of this company and expose their bully deceitful ways.

File complaints with your attorney General, the FTC and DOJ.

    https://www.ftccomplaintassistant.gov/
    http://www.ic3.gov/default.aspx
    http://www.justice.gov/crt/complaint/

You can google your state Attorney General..

It sounds like they are breaking the FDCPA laws...

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
    "§ 809. Validation of debts
    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
    (4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
    (5) a statement that, upon the consumer’s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

    A Collection Agent May Not…

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

Publishing the consumer’s name or address on a "bad debt" list is prohibited.

    Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

    Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

    Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

    Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Extortion Scam Related to Delinquent Payday Loans

    Washington, D.C.
December 07, 2010  FBI National Press Office
    (202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.

So, they are scamming my husband. He has never even filled out for a loan and they call here 2-3 times a day, and she gets very aggressive with my husband yelling at him that he needs to pay or he will be arrested for fraud, she has also, besides just calling my home 2-3 times, she has called his employer so many times, he has gotten written up for taking personal calls from them at work. When she emailed him the "statement " he supposely signed and filled out. He sent back all of his bank statements like she said to, in order to solve the problem and she claims they are fake, and he will go to prison for sending them fake bank statements. We are seriously getting tired of it. We recently had to get a lawyer to deal with it, and really considering a harrassment lawsuit.

You should print this thread and my post out.  Your husbands employer needs to realize these are 100% scam callers and he is not responsible for this ongoing scam.  He is a victim here 100%!   And they can get into trouble for firing him over something like this. They need to take steps like installing a call blocker and not accepting the calls and reporting them. Glad you got a lawyer..  and it is a huge mistake giving or sending them anything.

One important thing to remember if these losers have any of your personal information such as your social security number, date of birth or drivers license make sure you register with identity protection notify the credit agencies as well as your banks!!

Got a call today saying I owed $ 400+for a pay day loan I never had. Also claming that interest has built up over 4 years making my bill $1186 and some change. They wouldn't give me a case number or an address to send payment, also said to call back for a fax number if I had paid the bill years ago and to fax proof of payment.

As soon as you tell them ull see them in court they act nervous and hang up.
