- you're a shill replies to J.D.Shill alert! You already knew the account was paid off but still tried a shakedown. Are you still going to continue breaking the law and harassing the above poster?
- len replies to YoloWhether or not you acknowledge the debt is not an issue As long as you
DISPUTE the debt. Based upon the Statute of limitations, it is already time barred and legally uncollectable. You can stand in front of the judge and acknowledge that you created the debt, as long as you are disputing it based upon the fact that it is already time barred from going to court. If you fail to dispute it, the clock can be restarted, but it is unlikely unless you make payment arrangements or pay even one dollar before disputing the alleged debt.
Don't call people stupid just because you have a point that may differ. It doesn't make you appear any smarter and is a childish and impolite way to address anyone who is simply participating in a discussion. - dee replies to J.D.Sheesh....what a creep.
- Smart Guy| 3 repliesJust so everyone understands.
"Shill" typically refers to someone who purposely gives onlookers the impression he is an enthusiastic independent customer of a seller (or marketer of ideas) for whom he is secretly working. The person or group who hires the shill is using crowd psychology, to encourage other onlookers or audience members to purchase the goods or services.
SHILL is a sales term not a collections.
Just want everyone to understand this so they stop using it incorrectly. - jeff replies to Smart GuyPerhaps so. However, most who are referred to as shills on this board are collections scammers as well as other types of scammers. Google "Define shill" and there is a host of other definitions for shill, including sales, but I don't think that it has such a confined meaning that it is exclusive to sales. For example, go to www.internetslang.com/SHILL-meaning-definition.asp where it defines a shill as a "decoy person on a scam" As a lifetime marketing person, I'm aware that it is used in sales, but it also has uses elsewhere too. Some of the definitions indicate that it can be used in a latitude of ways other than just sales. How about letting everyone google "Shill" and let them decide whether the term is correctly used or not. Thank you for your post.
- kyle replies to Smart GuyIn my opnion the scammers and collectors using illegal methods posted about on this board are attempting to sell their PRODUCTS to people. That product is called Bull [***]! Anyone who comes on this board to post favorable comments, endorsing the sale of this product, are promoting the sale of Criminal Bull [***] and we can call them a shill or anything else we want. If you don't like it, get out of the office and go sell something or teach class to someone who really cares about Nit picking over nothing.

Decoy, Smart Guy, decoy - Victor Reyes, Jr.A person called identifying themself as a legal counselor on behalf of JD Mitchell & Associates. The person left a message instructing me to contact them or I would be summoned by deputies to appear in court. They left a case number and a call back number 1-855-271-0502. I can tell you all it is kinda like I was left an ultimatum by the individual, with the style of a clerk of the court. They did not tell what the purpose of their call was, and sounded like a police secretary. I thought there might have been a misunderstanding so I did not hesitate to call back immediately. I was transfered by the operator to speak to a Josh Summers. I agree he tried hard to do what few of you referred to as "Shilling". I found out that he was calling from a small collections firm. Can someone tell me if this company has been flagged by the FTC? I don't owe the amount the individual had on file ($900-$1000). It was maybe 10 times the amount I borrowed from a small merchant over a decade ago. I think this business is violating Title 15 USC 1692e- False or misleading representations. Which states: A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.
(2) The false representation of—
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to—
(A) lose any claim or defense to payment of the debt; or
(B) become subject to any practice prohibited by this subchapter.
(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.
(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.
(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.
(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.
(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.
(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.
(13) The false representation or implication that documents are legal process.
(14) The use of any business, company, or organization name other than the true name of the debt collector’s business, company, or organization.
(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.
(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 1681a (f) of this title.- Caller: JD Mitchell & Associates
