Secondly it is against the FDCPA regulations to threaten consumers of legal action without them having the opportunity to dispute. These people are frauds and try to collect on payday advance debt that does not exist using scare tactics to pay money you don't owe. a prime example of data mining of peoples personal information being sold. - SD| 3 repliesReceived a call from a restricted number on my personal cell. I couldn't answer it because I was on my work phone. Then they called my work number and left an urgent voicemail. It was from "Frank Baxter". He said he had several legal complaints filed against me this morning and wanted to speak with me before he filed charges in the county circuit court. He named my county. He ended the call with "you have been officially served". Then my 87 year old mother called and said she received the same message on HER voicemail about me and then my mother in law called and said the same thing. He called four numbers in about two minutes. He left 855-271-2602 for me to call back and left 855-256-1903 at my mother in law's house for me to call. I called the number and all the representative said was "National" when she answered the phone. She said I took out a loan last year for $1,100. I said I have never heard of that company and then she asked if I heard of another company. I said no again. I said I would be check with the department of financial regulation in my state to see if this was legal and I would check with my bank but I would have remembered a deposit in that amount and then I would call them back. She had to put me on hold to check with the attorney to see if a court date had already been scheduled. She came back said it had not (shocker) and he would waive the fees and I would only owe some other amount. I asked her the name of the company and she said "National". I said the only name of the company was National? There was nothing else in the title? She responded with National Pre-Litigation. I asked where she was located and said the name of my county. Most people would use a city name in my opinion. Then I asked for her address and she said she couldn't give me the address. I told her I had to go into a work appointment and she said I was taking a chance because they may not hold my account.

She was speaking super fast, mentioned something about a compliant with Diane Ortiz, and asked I call back to get an address on file. I will not be calling them...thanks!
- Walter Blevins replies to SD| 2 repliesapparently this guy was not a fraud he showed up at my job today here in Sacramento, and actually had the sheriffs office with him and served a employee for obtaining numerous PDLs and failing to pay them back since the law changed NOV 2012 they ended up hauling him to jail for intent to defraud a financial institution. WHOA the ghost shows his face.

2) How about a citation for that supposed change in the law? Here, I will give MY citation, proving an uncollected Payday Loan check is NOT "intent to defraud a financial institution":
Some Payday Loan lenders will attempt to convince the borrower that the check they left is fraudulent, and the lender will file a fraud case. Borrowers should read this:
"It is illegal in most states to write a check knowing that you do not have sufficient funds, with fraudulent intent."
