- Jamie| 4 repliesReceived a call about a package delivery to an old address. When I told them I no longer lived there I was given a phone number and a case #. I called the number and was given to a Chris Baylor. He clamed to work for a law firm and said I was going to be served r/t an ER bill from April 2005. He said it was in the amount of $5745 and he could keep it from going to court if I would make an offer to settle. After asking him if it was a scam he proceeded to give me the date of the ER visit, my ss#, DOB etc. He told me to counterclaim and he could speak with the lawyer and see if it would be accepted. He put me on a hold and while on hold I called the hospital to verify the date of service. When he came back on the line I told him the hospital didn't have a debt in the amount for the date, he then told me to have them check for a bill in the amount of $909.16. It all sounded off so I told him I was going to do some research. He told me I had until the end of business. My sister works for the hospital and informed me that there had been a breach in ER Files and that she herself had received the same type of call. They claimed to have me served at work or home and kept saying it was a civil suit and I would be taken to court. After much research I was informed that this was a scam. When I called him back from my cell phone I was put on hold for awhile so I called from a land line and he answered the call himself. Mind you he is suppose to be a big wig at a law firm with a secretary and all...when I told him I was on hold on the other line for him and that I felt this was a scam he continued to sound very convincing. As them to provide you with a Validation Notice before you give them any information or payment. When looking up info I found MCG, Miller Consulting Group, Chris Baylor, and the name Jessica all related to the same type of scam. If I get served in the future I will make sure to update this...Hope it helps

- BigA replies to Jamie| 2 repliesYou asked him if it was a scam and expected him to tell you the truth? That isn't even close to how debt collection is supposed to work.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

As I don't have any outstanding debts, I consider this to be a scam and will not be calling them back.
