This is what I say to the people who call me,. Funny how they do not call back or issue a warrant for my arrest.

I would like a verification of the debt and your ability to collect this money from me.

Under the FDCPA, I have the right to request a validation of this debt. I request that you prove that I am indeed the party that is contractually obligated to pay off this debt.

I hope you are aware that until you validate this debt, you cannot continue collection activities. Non-compliance of this request may land your company in serious legal trouble with the federal Trade Commission (FTC) and other state/federal agencies.

Please attach copies of the following documents:

Agreement with your client that authorizes you to collect on this alleged debt.

Agreement that bears signature of the alleged debtor where he/she promises to pay the original creditor.

Complete payment history on this account, to prove that the amount you wish to collect is accurate.

I was contacted by the same company and spoke with Kimberly Carter (who answered the phone "Do not call here and play games. How can I help you?" I was then directed through two different people and landed in the lap of a man named Jeffery. Jeffery claimed I took out a payday loan in 2008 and was about to be served papers and brought into court on felony fraud charges. He faxed me over a document that looks authentic but the strangest thing is, I paid this debt. I sent him the documentation of where it had already been paid and he told me the company I had paid scammed me out of money. I called the company I had previously paid and spoke with a gentleman who wasn't mean, or even upset that I was questioning whether or not his company was legally legit. I don't want to not pay an outstanding bill if I have one, but how can I tell which firms are legit and which ones aren't?

TRYING TO HELP replies to confused
you said you faxed over proof you have paid.  if the issue is the account numbers or claimant names do not match up them there are 1 of 2 problems.  #1 perhaps you have more than 1 loan out there, or #2 you were in fact scammed.

one of the big issues coming up over and over are scam collection agencies or supposed "law firm attorneys".  a consumers FIRST WARNING should be if they get a letter saying they owe BMG!!!!!!!
AT NO POINT DOES BMG EVER LOAN MONEY!!!!   they simply are the "hub" company.  the claimant will always be a loan company working for BMG, but never BMG itself!

If you are ever asked to pay BMG, you are being scammed!!!!

i review cases all the time with these places buring consumers.  then they get sued or have charges filed based on bounced check problems, and it wont matter in court that they were scammed and paid the wrong place.

just watch out and if you are trying to do the right thing and resolve your issues, just protect yourself when they come calling.  just make sure the people you borrowed from are the same ones on your letter that your paying back.

    clearly Joyce is an idiot.

Paragrah 2, line 2, same says they are debt collectors.  Also there is a whole section labled "debt collectors may not".

so perhaps Joyce should read carefully before making herself look like a fool.

Sam appherently has alot of experience dealing with debt collectors as he has spent alot of time looking up and posting information on collection laws.  maybe if some of that time were put into getting a job or paying his bills, Sam would be bothered with the calls at all.  sounds like a simple fix.

by the way, the FDCPA covers 3rd party collections ONLY, so it doesnt always protect the consumer.  consumers just read all this nonsense online and think they know it all.

as always, the best way to get rid of debt collectors, or atorneys, or anyone filing charges, or whatever else, is to simply PAY YOUR BILLS, and not steal money or credit.

I pay my bills. I get these calls all the time. I save the numbers and their messages and turn them in. They are scammers because they do not follow the letter of the law when collecting. I have looked it up and even asked my ATTORNEY who knows more than you.

Can you read and UNDERSTAND English? He was not referring to that specific company as debt collectors. Paragraph 2, line1 and 2 state “The "debt" is not owned by these people. Otherwise they would follow the law when it comes to contacting you and representing themselves as a legit debt collector.” These people ARE saying that they need to collect money from you, but will not give any information about the debt or their right to collect it. Hmmmmm….seems to me that would make them a debt collector of some sorts. Collecting debts…debt collector….yeah that makes sens….common sense anyway. Something too many people are lacking these days.

The second half of the response is quoting laws about collecting debts.

they called my job and told a coworker that They were coming to serve a warrent for my arrest, Bill Johnson the person that call told my coworker it was because I owe a debt. This is not legal, a debt collector is not suppose to till anyone your business wheather is true or not. I pay my bills I don't take out pay day loans because they are are scams. Does anyone know how to stop these calls. I called Bill Johnson and asked him to mail me the paperwork that show I owe that debt and he ask for my address. If I took that loan they should already have that info. I shouldn't have to give them my personnal info. Why haven't they sent letters to my house saying I owe. I've live in the same house for over 15 years.

You are correct they are not a collection agency. Sam post refers to them as scam artists. I believe he is correct.

I spoke with Michael Sullivan of GNA Legal Services "Pack Management Group" as he claimed the company name where he works is GNA Legal Services which handles delinquent borrowers from Pay Day Loans.  I gave him my VISA CARD to pay for my son's account and requested for an email confirmation of the payment.  I had to call him twice to remind of the email which I hope to get today - July 19, 2012.  When paying through a credit card, they collect 9.95 that is paid to the Access Recovery Group which he claims that they receive the payment ...... what a scam!!!!  You pay your debt with interest and they let you pay for paying them.....what can you say???  If I do not receive the email confirmation today, I will surely report them to the BBB and to the Illinois Attorney General's Office.

    So you may know...................

Harrassing Phone calls which I don't have a personal phone and they're calling my daughter's personal cell phone which we don't know how they could have gotten her number maybe skip tracing the last name. Giving her the threatening message for me if I don't call them then this David Webb is coming to arrest me. Horrible experience to have anybody threatening with the name of David Webb but won't let me speak with this person. I believe this is a scam and I don't know of no legitimate debt collections company that curses and threatens a customer they are trying to get money froma and hang up on them 3 or more times because I am asking for info. in writing from them to see if this is a legitimate company and not giving me a address for this company.

Yes, these people keep contacting me over and over and they have been tellin me for months now that I will be served for a payday loan and I haven't been served, ys i have had a payday loan that i did not pay and it was years ago and I have checked it out and these people cannot arrest you for that, payday loans are illegal anyway with all those daggone fees they charge!!!!!!!!!!  The most that can happen if you don't pay is it goes on your credit report as bad debt but being served papers no.  Then these same people have scammed me because I sent them $250 and it wasn't even suppose to go to them so I'm not paying them anything else. they are scammers!!!!!!!!!! You really have to be careful with these folks calling saying you owe a payday loan even if you know you owe one because 9 times out of 10 it is not the real person you owe!!!!!!!!  I have been got twice now and done paid out almost $1,000!!!!!!!!!!  I'm furious!!!!!!!!!!
