    They left numerous voicemails regarding a payday loan service that I supposedly owe. I called them back. I don't have any payday loans. They mentioned my family as a reference, which was very scary. I asked what is the name of this company and their client, they became irate, started using obscenities to me and hung up. This is a total scam! I reported it over to the FCC and my credit bureaus.

    Family info says they have a warrent out for my arrest if i dont pay $300 today!!! Ive never had a loan from dupaco! They have my social security number!!! They have someone coming to my house tommorow!!! I dont know what to do! Doesnt say the company name or anything!

    A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.

    The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed - US Mail ... not emailed or texted]

    Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via Green Dot, MoneyGram, Western Union, prepaid gift card or other untraceable means, then the call is definitely not legitimate.

    They aren't coming to your house.  They seem to be doing a good job of scaring you enough that you might pay them.  This is called extortion and is a common practice by criminals pretending to be debt collectors.  As Slim said, they must send you a letter, and they must prove that you owe the debt.

    If you feel you SSN has been compromised, in addition to putting a fraud alert at the 3 credit bureaus, you may want to notify the IRS.  Here is the link, fill out the proper form (probably 14039):

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    The paper work you guys are talking about has been returned from the last address i lived at. I find suspicious. Scares me half to death!!! Said i cant use my bank card i have to use another source of payment.

    Being in ordinary civil debt is not a crime and you cannot be arrested for it.

    Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

    If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

    Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

    If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    You'll probably have to yell at them and talk over them.
    You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking),  the only thing they understand.

    Sounds like a extortion scam operation to me. Untraceable means of payment - run away! Block em if you have a blocking device. Make sure you read through the info the others have posted.

    I doesn't sound like you have taken the time to read anything we have posted, nor have to taken the time to use the links to the proper agencies to learn what you need to know.  We can only do so much.  We are not here to hold your hand and give you a shoulder to cry on.  You need to help yourself and all the information you need to do that has been provided for you.  You can either use it or be a victim of a crime.  Your choice.
