- Florida residentReceived several calls from this number over five years, two recently. Caller wants to locate a family member who does not live at our home. Callers give a toll-free number with a case number. (Reverse look-up indicated Texas, but we have nothing to associate with Texas.) Sounds like a scam. Last call threatening legal action against the relative and the caller wants us to call them back and prove the relative doe not live here, which is suspicious "or" they would begin actions against the relative they think lives here. Caller did not want us "to be concerned", but continues to call us. Sounds like the scam where they hope we might protect a younger relative.

- Bridget| 6 repliesCalled stating a file would be sent to the court if we didn’t make an arrangement that day. We payed over $2000 in a payment arrangement. One day we received the same type of call from a different number in regards to the SAME debt . After some investigation, we learned it is a scam. These people are not legit. They cannot answer any questions in regards to the account aside from the original creditor and amount of loan. They will not give address to their company or the account number for the original creditor. Please beware.

- BigA replies to BridgetYes, because you paid them without making them follow the law you became an easy mark. Now your name is being sold as an easy mark to every criminal that will pay for it.
- BigAIt is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.

It wasn’t until after I received the second phone call that I started asking questions and doing research . Not that I owe you an explanation .

Us that do have debts and have gotten behind due to the pandemic might also be easily duped. - Tygerkat replies to CharleyThat's why any time someone calls claiming you owe money you tell them to mail you proof of the debt along with proof they're legally entitled to collect said debt. Phone calls are not a legal method of debt validation. Nor are faxes, texts, or emails.
