Did you ever find out about this phone number? - KyleCaldwell and Associates is the name of the "company". After my interactions with them, they appear to be an illegitimate company, possibly trying to commit fraudulent activity by phishing for personal and/or banking information. In my opinion, I would not give them any information whatsoever. If they end up filing a legitimate lawsuit, then battle it in court. However, I have a feeling that they love to try and pin family members "unpaid debts" on you.

- Shanelle| 1 replyI received calls from a Michelle Smith with Caldwell & Associates. They said they are collecting on a payday loan debt and threatening to sue me. I requested verification and all they would send is a generic looking email. The address they reference on the email is actually a Caldwell & Ober in Arizona..a real firm that handles DISABILTY/SOCIAL SECURITY CASES. I called Caldwell & Ober..they had no idea what I was talking about. I called Mrs. Smith back and left a message regarding my interesting google search....she hasn't called me back. Idiots

Federal law (FDCPA) requires them to send you a letter within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of the date of the letter and if you do so, all collection activity must be stopped until the debt is verified.

Also file a complaint with your State Attorney General's office. - reginald matthewsThey called a family member of mine stating to get in touch with them and when I did, they were talking about me getting a summons to go to court about an unpaid payday loan. They tried threatening me with going to court and possibly going to jail if I didn't pay the debt. At first they tried telling me that they couldn't work out anything with me and then turned around and wanted to put me on a payment plan. Sounds very suspicious!!! 😠

What legitimate law office will not give you an address? Clearly some creepy debt collector or general scammer who's doing their best not to let anyone know their location. - Tina| 1 replyi received a call from this number, came up as unknown on my cell phone, at first it was a guy yelling at me saying he was going to have me served at work for a outstanding debt to cashnet, and to call this number and pay, well stupid me i did, and when the transaction came thru on my bank acct,,, it said it was a purchase for home furnishings and decor...so i contacted the bank and they stopped payment...so the woman by the name Michelle Facenda,said that that was the code that the company uses and that they must have made a mistake in the numbers....so she then told me that she had received word that my bank didnt process the claim and that the acct would be reopened and persued in court....she asked what she could do to get me to pay the acct...i told her to send me a letter on her letterhead with the acct numbers of this debt and the company....so she sent me a homemade email with her suppsed address....i looked up that address and its to a law firm that is closed....and that firm was a divorce/family law not debt collecting....and whats more interesting is that the letter she sent me has the fax number the same as the phone number.....again interesting

Tell the caller to comply with the Fair Debt Collection Practices Act (FDCPA) & MAIL you a notice of validation. NOT an e-mail or fax. Don't be surprised in the slightest when your caller becomes irate & goes on to make excuses & more threats. Scammers rarely mail anything. Doing so constitutes mail fraud & that's a federal crime that carries heavy penalties. Scammers are cringing cowards & will only stretch the law so far. The thought of doing federal time loosens their bowels.

Gunnar - Ann| 2 repliesGot an email from, these people as well as phone calls threatening lawsuit. did some digging and the address listed at the top of email is to a shopping center and the physical address is to an UPS Store with mail boxes. The shopping center manager stated that there is no Caldwell and Associates in the shopping center and the UPS manager stated that he may or may not have a box for them but can only give out that info to the police. Which is my next step! Michelle Facenda is a scammer! please don't fall for this.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:
Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money. ["Written" means snailmailed - US Mail ... not emailed or texted]

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via Green Dot, MoneyGram, Western Union, prepaid gift card or other untraceable means, then the call is definitely not legitimate.

- Judie| 1 reply2 years ago this lady called me threatening me to sue me and all. So I'm not very familiar with any of this. Well i end up paying her. She sent me an email with transaction number and the loan cashnet. USA . Etc. But now other people calling me saying i owe them $2100 for Cash USA. Saying the exact same thing. Financial solution is calling. I tried contacting this lady michelle n her company to get some kind of paperwork saying i paid this off. But number is disconnected and law firm can't be found. I don't want to pay this again. If this is a fraud what should i do?
