BBB has seen a major increase in collection agencies setting up businesses in the Upstate New York area over the past several years. In an effort to keep consumers informed about which collection agencies are operating in accordance with Federal Law, we are asking for specific information from all collection agencies operating in our service area. The requests includes the following:
:Federal Employee Identification Number-EIN
:Proof Of Licensing, bonding and or registration by the city, town in which your business is located.
:Proof of licensing required by any state in which you operate by mail or telephone or email.
This collection agency has not responded to our requests.
BBB advises consumers to be aware of their legal rights in regard to collections. The Fair Debt Collection Practices Act is a statue enacted in 1978 which seeks to eliminate abusive and harassing behavior by any debt or collection agency. The act states specific practices and rules under which debt collectors must abide by. There are penalties for agencies found breaking these laws. Some of these laws state that a collection agency is forbidden to harass a debtor, which includes threatening violence or legal action. They may not use crude or offensive language or identify themselves as anyone other than by their business name. If a consumer believes a debt or collection agency has violated any of the FDCPA laws the BBB encourages them to file complaints with the BBB at bbb.org and Federal Trade Commission at ftc.gov

- former employee at Cred x Recovery| 1 replyto all consumers out there. i am former employee black male from a year ago at cred x-debt recovery and this collection agency is misleading and "phishing consumers information". Cred x recovery violates the FDCPA ..fair debt collection practice act which protects consumers from being harass from debt collectors such as cred x debt recovery. First of all they are using a "dynamic dial-er" which calls from the same area code the consumer reside in, when the consumer pick up or calls back the number is disconnected. Its a tactic payday loan company uses to mislead consumers. Next, cred x debt recovery has no "verification dept" to verify payment. They uses other collectors for different voices on the phone. Cred x debt recovery employs about 20 employees. Furthermore, do not give cred x debt your personal banking info and credit card because once you default on the payment u have to open up a new financial institution. Managers and collectors is harassing consumers by the tone of their voice, misleading info that consumers will be court summon and sue by their client NCA (national credit adjustor). If a consumer owes payday loan debt u dont have to pay it back!
Also, managers such as Jake Duggan has been harassing consumers by his tone of his voice, misleading the consumers.

Also, some of the collectors said after the conversation was hung up they called consumers "scum bags, using profanity against consumers". As a former employee, some of the collectors dosent even own a car, taking buses to work..lmao!!!!.. they act like they own u on a conversationon the telephone. Please dont get intimidated, report then to the FDCA hotline number and report them to the NYS Attorney General Eric Schniederman, the agency will get shut down the more complaint!!!!. In matter of fact, the building next to Cred x Debt Recovery has shut down when law enforcement raided around november 2014 last year, it was on national televison "Dateline"., google it u will see a healthy manager training new employees to harass consumers. That is a clear violation of the FDCPA and FTC..report it please.
Also more i have seen collectors pulling their cell phone right in front of the computer monitor..that is a clear violation of the FDCPA because collection agency deal with sensitive information.

- Janet MikutisThis has happened to me on 2 separate occasions in the past 6 months. The caller {a foreign female} claimed that I had defaulted on an "Online Loan" back in 2012. They had my last 4 digits of my social security #, my last 4 of my bank account, and knew my place of employment, I'm freaking out, right? They then claimed I owed $400 to a Mesa Financial. They said if I don't rectify this situation immediately; the Police would be at my door and my workplace's Human Resource director notified I asked them to send me written documentation and was told "We don't do that!" The calls were relentless. I actually went to the Police and they said it was a scam. Finally, my husband cussed them out and told them not to call-we had their # and I had already played the voicemail for the Police! Then Peace for a month or so until Today. A man this time; horrible connection-from the 855-546-730, same creditor, direct deposit payday loan, the repayment now was $820. He knew the same stuff about me! I told him that I needed documentation for my Attorney-He emailed this letter-head:

He was called about an alleged loan we took out but had never paid and kept trying to get me to confirm the last four of my SSN. He was not rude but did say he had called my wife and mother also. I told him that I had googled his number and everything online said it was a scam and that I wasnt going to do anything until I saw something in the mail, to which he responded "we've sent multiple notifications to (wife's email address)". He had no problem giving me his companies mailing address but I'm not sure what good that does me?

Today, a man called and said it needed to be paid and in order for them to set up any payment arrangements, needed a debit/credit card on file BEFORE sending out any email about this. Who gives info like that before looking at what is suppose to be owed? Stupid.... Some Tips:
*Keep all messages
*Take a picture of your Caller ID
*Keep any and all conversations recorded to your states recording laws, some require they be told, others do not. This can be transferred to a recording device.
*Keep a notebook handy for writing time,date, who you spoke with and what the conversation detailed.
*Check your SOL for your state as well.
*Attorneys need to be licensed as a DC to collect, all DC's must be licensed in their state as well as yours if different.

Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a DIME until the debt is validated.
Of course they won’t do this, no scammer ever will, so simply block their calls and ignore them.

If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. You might have to yell at the scammer and talk over him or her. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them .
