A woman named Roxanne called me and saud i needed to be available between 12 and 3 tomorrow - 11/28 with 2 valid forms of id to sign off on legal documents for a case filed against me.  If i need to reschedule this i need to call 855-603-5784 .  This is the number of the company who filed this  case.   If I am not at home they will proceed to my place of business and serve me with the documents there.  Do i smell a scam? ???????  The number appeared on my phone as null+

Yes, you smell a huge scam and a very well known one around here.  We call it the "fake process server extortion scam".

They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid. 

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

just got a voicemail from a ny number telling me the same thing, please if it is true come serve me , until then i will not answer or call it back, some of us are smart to not fall for this scam!

Just called my place of employment and left the same exact voicemail message.  I almost immediately google the number and appreciate everyone taking the time to log these calls.

Thank god for this site. They called yesterday and freaked me out for the whole night. Finally googled it this morning and talked to an attorney (I work at a court so it's pretty hard to pull a scam like this on me, lol). Thanks for posting your reply, BigA! Once I read your post everything you said just makes so much sense but they try to get you by confusing you. I've been served in the past and always got mail ahead of time and they didn't call me first to warn me, like you said. You're saving a lot of people stress.

So happy I googled this number... I got a really realistic call from a lady named Miranda Wright.... (get it Miranda Wright)  actually, I was a believer... she really had me fooled of course I didn't answer the phone because it was an unknown number to me and frankly I was expecting a process server to come to my house .... and I spent like two or three hours trying to figure out who was going to sue me.... anyway this site is great!!

Hello. I received a call from an individual starting the same name! To ease my mind a little more, did someone ever come?

Received call from this number and said had complaint filed but didn’t in the message that was left say who they were looking for but did say if I didn’t call them back they would start calling Family until they got hold of me or until local court found me. Caller did not say who they were or where calling from or who complaint was from. Be  careful of this number sounds very sketchy.

Called my ex husband stated that they were a process server going to serve me at my new address with my old name
