A Collection Agent May Not…
Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:
Misrepresent Him or Herself
A debt collector may not misrepresent himself as an attorney or law enforcement officer.
Use the Telephone to Annoy or Harass
A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.
Threaten Arrest or Lawsuit
A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.
Use Abusive or Threatening Language
A debt collector may no use abusive or profane language in the course of communication related to the debt.
Publish a Bad Debt List
Publishing the consumer’s name or address on a "bad debt" list is prohibited.
Contact By Embarrassing Media
A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.
Contact a Consumer at Work
A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
Seek Unjustifiable Amounts
A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.
Contact a Consumer Represented by an Attorney
A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.
Communicate With a Consumer After Receiving a Validation Request
If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.
Communicate With Third Parties
A debt collector may not reveal or discuss the nature of a consumer’s debts with third parties other than the consumer’s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.
Bills.com FDCPA FAQ
Below are questions Bills.com readers ask frequently:
Can a Collection Agent Call My Cell Phone?
Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.
I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?
No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.
A Collector Says I Will Be Arrested if I Do Not Pay
This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt. - chicken little replies to sarahI believe that like the sky is falling.
- qwerty replies to RahYou can keep posting under different aliases but your continued bad advice (and bad spelling) continues to give you away.
I DO know my rights - I live in a TWO party consent state, so unless I informed the other party that I was recording, those recordings are about as useless as your posts. - CWG40 replies to David| 1 replyThis is a total scam. Being in ordinary civil debt is not a crime and you cannot be arrested for it. Defaulting on a pyaday loan is not a crime and you cannot be arrested for it. Civil debt is a civil matter.
Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.
If they are bothering you, report them:
http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening criminal process in order to collect a civil debt is a clear violation of the Federal Fair Debt Collection Practices Act.)
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them. Tell 'em no scammy debt collector is going to push you around.
You have to get tuff with these people because, being akin to thugs, brute force is (metaphorically speaking). the only thing they understand. - Al replies to Tara ArroyoNot contacted by law enforcement

- CWG40ID themselves as "Process Forwarding International". Supposedly a process server group. I asked her what state they were located in since most process server who are not sheriff's deputies or constables have to be licensed by the locality they are in. She refused to say.
I Found this, but the number and business may be spoofed.

- KimI received a call from the above number at 12:51 PM today, January 19th, which went to voicemail. The person said she was Melissa Johnston and that she was calling me for a two part felony complaint and that charges were being filed and that papers would be served and I would be arrested at my home or work. The company was stated to be Process Forwarding International, which I did find online. She only provided my maiden name (first, last) from before 1990, after which I was married. My son called it as a scam. I did try to call back and reached a voicemail with a different female voice that gave no information except that the party I was trying to reach was not available. I left a message with the number that I was called at and my current name and I left the individual know that I believed it was phishing. I hope that no one out there is taken in and gives these jerks their personal information or money, etc. My intent was to get them on the phone and ask so many questions that their heads would spin. Be careful out there! :)

- jea| 1 replyCall from 2 different nbrs: 855 607 3359 and 505 273 7624 that i need to call jacob adams because there are 2 complaints against me for international wire fraud. I must call back immediately to avoid sheriff's coming to my place of employment or residence and take me away in handcuffs. Caller does not even identify the name of his supposed company, only his name which is probably phoney & he's using some innocent person's name. Regardless of which nbr you try to call back, it's only an answering machine. I decided to call back and just give me the nbr to my local police department.
- Caller: NOT IDENTIFIED - ONLY THE NAME JACOB ADAMS
- JEA replies to hatescammersI am reading your complaint. I too received that I have 2 felony charges. It is strange that they seem to tell everyone there are 2 sets of charges. We are in the United States and I can't believe the government and FCC cannot or do not do a damn thing. Neither can AT & T. It's a little frightening. What I did was left them a voice message telling them to contact my police and sheriff's department. I did not identify the nbrs they would be calling. Just told them to call me back on these numbers. We'll see.
- Jea replies to moniqueReply to Monique. Monique I started receiving the calls today. The person who told me to return his phone call as it is gravely important that I do was a Jacob Adams. I am not deleting the voicemail he left me. I find it might strange; however, that they leave these types of threatening messages and many times, never leave the name of the business and refuse to give you information on who is actually filing charges against you. And, they seem to refuse to mail you information. Something needs to be done about this. If it's not people in the U. S., it's foreigners from somewhere in India.
- Jea replies to CWG40This is good advice. I will try it. Thank you.
