- ToriLeft me a message saying I have a pending legal matter in their office and have 24 hrs to contact them back at (855) 686-5392. The message said the company name was Milestone. I called them and a lady picked up and said the company name was MRG and got really defensive when I mentioned to her that I was looking her webpage up. She said they don't have one and didn't have to have one. The more I asked about the company the more aggravated she got and she hung up. I called back and got a guy this time (the same guy from the voice message) and he said the company name was Milestone. When I confronted him about the two different company names he said, same same and that one was just the abbreviation but didn't bother to explain how.(Really) So from there to sum it up, he went on to say that I had some payday loan of which I didn't have any more because it was paid over 4yrs ago. I told him that if anyone else called me to scam money out of me or used my personal information illegally anymore that I had their information and would report them to the PD. I haven't had anymore phone calls from them as of yet.

- Sam| 1 replyApparently this is a new scamming, bottom-feeding company that likes to try and con people into paying money they don't owe. Seeing the earlier reports from very recent dates, this must be a new form of an old scam.
I made the mistake of getting involved in payday loans years ago when I was a single parent trying to make ends meet. Worst mistake I ever made in my life, but I was able to get out of it eventually - but now, years later, I still get the occasional phone call from some scam company trying to collect. I paid off all of my loans, or sent our State's Attorney General office after them, because they were practicing illegally in our state - and I had already paid them enough in fees and interest to have paid off the loan several times - so our State's Attorney General sent them a cease and desist order and I received a paid in full letter from them.
A few tips if you're getting calls from these people (this is going to be long, but I hope it will help some people):
1.) Demand that they verify the debt. If they are a LEGITIMATE debt collector, they have to provide verification of the debt, in writing, within 30 days of contacting you. (Trust me, these people won't do it, because chances are good that the payday loan was illegal in your state to begin with - especially if you obtained it over the internet.)
2) Ask them why they aren't using the standard FDCPA statement when you answer the phone - saying "this is (company name here), this call is an attempt to collect a debt, and any information obtained will be used for that purpose" - again, if they are LEGITIMATE, they have to make this statement and identify themselves when you answer the phone.
3) Ask why they are automatically leaving messages on your phone saying it's a pending legal matter without making any attempt to find out if they are leaving a message for the correct person? Again, violation of the FDCPA. They must confirm they have the right person before leaving any personal information in a message - like saying "a pending legal matter".
4) If they are threatening to come to your workplace or your home to "serve papers" or have you sign something, tell them to go ahead and show up, and you'll have the local law enforcement and your attorney there to meet them. They won't show up. Have you ever been served papers by anyone for anything? They don't call first. If they were to call and tell you they were coming to serve papers, no papers would ever be served - ever - to anyone. People would simply not be home when the process server showed up. When papers are served for a debt, a court summons or any other legal matter, you are not notified first - they simply show up and hand you the papers. These people are relying on your ignorance of the legal process of debt collection to scare you into paying something you may not owe.
5) Block their numbers and don't take anymore calls. If they are calling you at work, you will probably have to get your supervisor involved, which will be embarrassing, but if you don't stop the calls, they will call other people in your office to try and reach you, which will be worse.
If you are caught up in the nightmare of payday loans, here are a few tips:
1) Have a meeting with the branch manager of your bank. Be honest with them and tell them you got caught up in payday loans and need to get out of it in order to regain control of your money. Most banks will be very understanding and will help you through this - admitting you made a mistake in getting involved shows responsibility and a willingness to do the right thing to get back on track. Most banks will recognize this and be willing to help. Ask them to either block ALL ACH ACTIVITY on your account or close the account completely and open a new one with no ACH access allowed. You will have to pay your bills with money orders or by check for a while - no debit card or ACH access to your account. That's the only way this will stop. However, if you open a new account and start using payday loans again, you can fully expect your bank to close your account immediately and you will have a hard time getting another, because they will report you to the agencies that keep track of bad check writers and fraudulent bank accounts - and every bank in the country will know about you when you try to open a new account.
2) Find out if your loans are legal in your state. Most states do not allow internet lending. (Some do.) Go to your state's website and research what governing body is responsible for the oversight of payday lenders. Some call them check cashing businesses or short-term loan businesses. Once you find that out, go to the governing body's website and find the payday lender laws for your state and the list of licensed lenders. Look for your lender names and make sure of whether they are legal or not. If they are legal, pay them off according to their terms. Call and ask for a payment arrangement and see if they will work with you. Once they are paid off, request a Paid In Full letter from them and keep it on file for future reference.
If they are not legal, calculate how much you would have been required to pay if they *were* legal under your state laws (principal + interest amount allowed by your state - not THEIR interest rate). If you have already overpaid your loan according to your state laws, file a written complaint with your state's Attorney General (or whatever governing body oversees payday lenders in your state) and call that office to request assistance resolving your loan with the illegal lender. Once the loan is resolved, request a Paid in Full letter from the lender and keep on file for future reference.
4) Start a small emergency fund - even if it's $5 or $10 a week. Put it in a savings account, or if you can't trust yourself to leave it alone, give it to someone you trust to hold for you. Keep adding to it so you have a small cushion to work with when times get tight instead of using payday loans.
3) Never, ever use a payday loan again. Borrow from family, friends or simply go without if you can - if you are this deep in the payday lending game that you are getting calls like this, you understand already how bad it can get - these people are ruthless and will never stop harrassing you, even after you've paid (the illegal ones will haunt you until the day you die, because they keep re-selling your file to new collectors every year, and then that collector sells it to another, etc.)- Caller: Miles Stone

- Tired of the scamsThis happens to me about once every 1 to 1 1/2 years. One time the person even (is it called spoofed) the state buildings phone number that was not used anymore on my caller idea. Once I reported it the state went after them and I don't know the ending results. It happened again with the same type of message as above and even called the company that time and confronted the person with the company. He never backed down and kept the threat so I told him to come and serve me. His so called locator tried to be very intimidating and harsh. Very threatening. The calls stopped after I offered for them to come to me.
Now this one. She was very nice I blocked her number the first time she called and left a message but now is using "unknown" on my phone. She did not give me a name of company just the #. I think I just turn this in to our Attorney State General with the voice mail and let them do what they do. It is a scam though. It just so happened the 2nd time this happened to me I did owe the money and had been paying it to a different a collections company. I called the original owner of the loan and asked them if they changed companies and they said no. The people were scamming me and to keep paying the original company.

- Amanda replies to ZenDo NOT give them your info. They called me this time last year (and today) saying they were trying to serve my husband papers. They weren't. They are NOT a law office.
- AmandaThis number called me this time last year as well. They gave me the whole we will be suing you bullcrap. In my state if you say you owe a debt even after the debt can no longer legally be collected it starts the time period over. They called today saying they were Milestone so I looked up the number and found this. I called back and told the lady if I received another call I would report them to the BBB and stated they were violating fair debt collection practices making her very aware I knew they were, in fact debt collectors. She asked me what number I received the call at and hung up on me after I gave it to her.

- Amanda replies to SamAlso, and this is per a payday loan manager, if you make into a payment agreement on the loan they cannot come after you. Even if you can no longer pay for whatever reason.

- L bellThreatening calls to see me in court. They refuse to say who they are. All they say is that they represent MRG. Extremely rude and abusive people. They won't give an address or a legit phone number of wher they are. They demand that I acknowledge that I am the person that they are trying to harass. I'm really sick of these calls. They have been going on for a few years now.
