I got a call on Monday from this person telling me that I had a lawsuit against me for a debt from 5/3 bank.  He said if I didn't settle for 50% I would be taken to court and my wages garnished.  I cannot find information online about Mason Roth and Associates and stupidly gave them a $100 deposit.  I assume it is a scam, do you think so?

I received the same Call yesterday, saying I owed 3660 dollars or could settle for 636 right now to fifth third bank also.  First I talked to a man, then was transfered to a woman who called herself Anne shultz, her extension was 113. Said I had to research the charge and she put a "24" hrs hold on it. Have you heard back at all or any further info?

I ended up disputing the fund and got a new card.  The more I have researched the more I feel it is fake.  I found a few other complaints about an Anne Shultz. https://800notes.com/Phone.aspx/1-888-676-7287

I will likely not get my $100 back and feel so stupid.  I am so mad at myself.  They scared me with the lawsuit and the fact that they had a "legal document delivery service" call me first from a local number and then that.

A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

Unless the original communication contained this specific information, every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed - US Mail ... not emailed or texted]

    Source:
    https://www.consumer.ftc.gov/articles/0149-debt-collection

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via Green Dot, MoneyGram, Western Union, prepaid gift card or other untraceable means, then the call is definitely not legitimate.

REMEMBER THIS IF YOU FORGET ALL ELSE:
    1.  Legally, THEY must prove you owe the debt (you do not have to prove to them that you do not owe the debt)
    2.  They must prove they have a legal right to collect the debt
    3.  They must send you snailmail with specific info within 5 days of the original contact, if you request that validation, or if that information was not provided on initial contact.
You have up to 30 days to reply to that validation.

IF you wish to communicate with the supposed collector / creditor, visit  the following page, for example "Action Letters" to snailmail:
    http://www.consumerfinance.gov/blog/debtcollection/

If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:
    http://www.consumer.ftc.gov/articles/0258-fake-debt-collectors

Yea, I know I fell for this, stupidly.  I checked my credit report and it isn't on there.  They wanted payment from a credit card I had (not sure how they knew about that) but when I said it was from Victorias Secret they wanted my debit card info.  I have no clue if I will win the dispute for this.  :(

    I feel so dumb.

    Scared me with lawsuit
Ok yesterday I received a call from a woman named Candice, she said she was from a " legal document server service" she called from: # 615-645-1944. She said my name, birth date, and old address.  Said she couldn't give me any other information except the docot# and phone# 855-686-6847, and I would need to call  Mason, Roth, associates no and after Roth. She even spelled it for me and I never asked her too. So I called... a Micheal answered the phone , not a secratery or assistant. I told Michael my name and told him this is the first I have heard of this law suit and I believe it's  been too many years to come after me anyway. He informed me that as long as the credit card company had never pursued this it was legal he could assure me. He said it was a capital one visa and I owed $2,232.04,  and they, (capital one) had offered me a settlement of $1,352.00 but I didn't respond to that offer. (I Never!! Got an offer.) He said However, sense I sounded like a nice lady he would try to make arrangements with his client to take a lump sum payment of $500 or $600. I had to offer a down payment or something to stop the lawsuit. He said With that I would never have to worry about it again. Wanted a comment with in 48 hours. I laughed and told him I was sick and on oxygen (that's the truth) , and have nothing live with friends and if it wasn't for them I would be on the street. He told me to ask them for the money and I could work paying it back with them. He said no doubt they care about you or they  wouldn't have give me a place to live. Told me to call back after I received a email.... I give them a friend's email address for proof of this lawsuit and he was going to have his secretary send it right out.  He said 15 minutes. I called again at 3:46pm again at 3:53 and told him again no email he said this time he would take care of it personally. As of 9:00 pm no email. So I called again and left messages of that fact. At 10:12 am I called again no email "Micheal said he would send it his self this time. I said that is what you told me yesterday. I asked which Court this was thru he said that is why we are trying to work this out together so it don't come to that. When I said something Thathe told me yesterday that paying this he could stop the lawsuit. Then he said he needs to go he has to be in court and to call him back at 2:00 today. Must figure something out or I will be going to court. I don't know what to think....Then I saw this thread 😀😀😀😀😀😀😀!!!!!!! I'm was scarred but I do feel a little better now I've read this thanks everyone for speaking out. I'm too old...And what few friends I have do enough for me. Thanks again.
Should I block their # or call and tell them they are a fraud????

Yes, it almost certainly is a scam.  Do not pay them any money.

Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

If they are bothering you, report them:

http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening civil proceedings with no intent to follow through, or threatening criminal process in order to collect a civil debt is a  violation of the Federal Fair Debt Collection Practices Act.)  The same goes for endless telephone harassment

Also contact your local attorney general

If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

You'll probably have to yell at them and talk over them.
You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking),  the only thing they understand.

I called that number and the guy said "Mason and Roth".  Claimed to be in Laguna, California but would not give me any more information.  There is no Mason and Roth that I can find.  I'm pretty sure this is another manifestation of the Brockton-Moore Consulting scam.  But I can't prove it.  This "Anne Shultz" appears under something called Brockton Capital.    See 888-752-0651 800notes.  Along with this "Pam Jenkins".  See also 855-427-2194 for "Anne Shultz" again with a Brockton CID.

They are using a variety of CIDS.

OMG!! They contacted me to back in January. They said I owed Wachovia and I never had an account with them. I stupidly paid too, but when you're feel threatened with a lawsuit..what are supposed to do. I received a call today saying if I  don't call them they wil serve me court papers to my job. I've done my research with Wachovia  and couldn't find anything. I also did a consumer report and they found nothing as well. So I'm not going to worry about it. I find it mighty strange that a "debt collection company" don't have a valid website. Good luck to you and everyone they're trying to scam.

My mother called me today and said  someone from Mason Roth and Associates called her cell number looking for me. Their number came up private, they told her that her number was an alternate number for me. I have never given anybody my mothers phone number for an alternate. They gave her a reference number for me to call them back. She did not give them any information. The phone number given to her for me to call is 877-574-2325. I called the number and of course got a recording for Mason Roth and associates. I have been all over the internet with the name and ohine, can't find them anywhere. I believe this is a scam!!

They threaten to take me to court if I didn't make a payment plan for a bank account I never had. I eventually cancelled my debit card and got a call from Legal Delivery Service saying they were going to come to my job and serve me papers. DON'T  TALK TO THEM.
