    Called me from an unknown number. Said its in reguards to a pending suit in my county for fraud. Of course after I spoke to my attorney Icalled the number back and conveniently the person that called was in a "meeting". Anybody else get a call like this?

    I've received this call twice now, coming from an unknown number, once on Dec 5 and once again today. According to the voicemails they were from the 'CRC firm' and it was regarding a pending suit in my county for fraud. I'm going to guess unknown number + generic company name = not legit.

    Yes I received the same call. I dont know how they got my new cell number, nor my unpublished and unlisted number that has been on the Do Not Call Registry.
    Dont let these scammers 'rattle' you.
    The man told me they were a law firm investigating a case of fraud in that I had taken a 'payday loan in 2011'. I have Never taken a payday loan...in my life.
    He said his name was Tim Moran, he also has a [***] female, goes by the name of Lynn Hollister.
    People, just hang up on them and dont answer "Private Number" OR "Unknown Name" calls. 'Tis the season for the scammers....unfortunately....

    "Joseph Black" from "CRC"  ext. 520 as he identifies himself has continuously called me, my family members and friends for the past three weeks.  I have had this type of threatening phone call in the past and so I knew this was a scam and did not return the call.  As annoying as it is to me, I know it is a scam and ignore the calls. However, they are calling and threatening my family and my friends now with a lawsuit for fraud and I feel there has to be something I can do about this.  Anyone have any thoughts?  In addition, if there are this many reports on this particular company and phone number over the past several weeks, why aren't they shut down or in jail yet?

    Just because a voice on the telephone claims you owe a debt does not mean you owe it
    If a voice on the telephone claims you owe a debt:
    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated
    If they are bothering you, report them:

    If they continue to bother you, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    They ID themselves as Capital Resource Consultants.  More than likely a typical New York located debt scamming operation. Endless phony threats of arrest, service of process civil actions, everything that most of these fly-by-night operations engage in.    Ignore their calls and block them.  Also report them.

    Just got off the phone with this guy, claims that I got a loan from a company called "Bell Financial", no other info on the company. Said that they sent me something via mail earlier this month, refuses to resend me anything new in the mail. Wants it done by E-Mail.  Been almost 30 minutes now, still nothing

    I demanded they send me something, but was told it had to be done via E-Mail since they already sent me something once. This Joseph Black said that he couldn't hold it for much longer, I was going to be taken to court for check fraud and a bunch of other things.  Here's the E-mail I just got.

    Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
    "§ 809. Validation of debts
    (a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing—
    (1) the amount of the debt;
    (2) the name of the creditor to whom the debt is owed;
    (3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
    (4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and

    A Collection Agent May Not…

    Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

    Misrepresent Him or Herself

      A debt collector may not misrepresent himself as an attorney or law enforcement officer.

    Use the Telephone to Annoy or Harass

      A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

    Threaten Arrest or Lawsuit

      A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

    Use Abusive or Threatening Language

      A debt collector may no use abusive or profane language in the course of communication related to the debt.

    Publish a Bad Debt List

      Publishing the consumer’s name or address on a "bad debt" list is prohibited.

      A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector’s address, on any envelope when communicating with a consumer by use of the mails or by telegram.     Contact a Consumer at Work

      A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

    Can a Collection Agent Call My Cell Phone?

      Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

    I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

      No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

    I have received 2 phone calls from these individuals. The messages say they are the litigation department and are calling regarding a civil complaint filed against me by a prosecuting attorney.
    I normally do not answer the phone, but decided to today. They said that I have pending fraud charges against my name in "my county" and that a sheriff has been dispatched to my location today. It was supposedly from a payday loan in 2011, which I never had. I told them that I would be contacting my representation and they would call back. The woman tried to talk me out of having my representation call, and said we could handle this on our own.
    I made her send me an email with my "charges" listed on it. And it was, indeed, a collection form. The form does not list any of the "criminal charges", but rather just the debt information. The letter was written to another woman's name, address, phone number, and email address.
    I also called from out of town, but yet she tracked my location and said the sheriff was on his way to me now. DO NOT CALL THEM. They will track your location and try and scare you.
    I made calls to 2 of the sheriff's offices around me, and just like I suspected, it's all a scam.
    Be careful. Do not give them money. And do not call if you don't have to, you do not need the added stress.

    same thing happened to me. he was calling my father. his name was Joshua Matthews. He would not give me any paperwork in writing when i asked.. He kept trying to talk me out of the actual bill and said that he could have the "girls " type up an agreement. I said i'm not agreeing to anything that I dont see in writing. He said there is nothing in writing. I said well what information did you receive to call me.. thats what I need.. still no information.. i'm certain this is a scam.

    i started getting calls last week from a brian evens same phone number 855-695-1311 like said the no. is unknown.now i did a year ago take out some pay day loans but went through pay day loan debt asst program and well lets just say it didnt go well.so he calls me tells me they will settle for 1221.00 which i no i did not take a loan out for that much.i ask him who do i owe this to he said after i give my debit info to set up payments he will send me a email.and i hung up.now he called back twice said this will be sent to the sheriffs dept on monday and legal action will be taken.i no what pay day loans i took out and he couldnt tell me anything just wanted to set up payments through my debit card.i said send me it in writing and i will make payments if it is to whom i owe he said we dont do this,i will get a email on whom i owe after i give my debit card.what should i do can i be arrested?

    Total scam.  There is no prosecution.  Prosecutions are done by public prosecutors in your district.   These people are simply debt collectors ignoring the law. There's no law enforcement involved in an ordinary civil debt.  Being in debt is not a crime and you can't be arrested for it.  

    Demand a debt validation letter be sent to you by US mail.  E-mail no good.  Of course they wont' do this.  So at that point just block their calls.  Do not return their calls.

    They cannot "track" your location.   It's true they can tell where you are calling from but that's just phone tech stuff anyone can do with the proper equipment.
