Ordinary debt is not an "arrestable crime".  It is a civil offense.

A phone call, email or text message from a supposed debt collector is not legally sufficient evidence of debt.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

    * Every collector must send you a written “validation notice” telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don’t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

Therefore, if that caller wants you to pay immediately, before you get the written validation notice via snailmail, or if the caller wants payment via green dot, Western Union, or other untraceable means, then the call is definitely not legitimate.

IF you wish to communicate with the supposed collector / creditor, visit  the following page, for example "Action Letters" to snailmail:

If you KNOW you owe no money, or believe the call was from a fake debt collector, please take the time to read this:

This caller called me said I was to call  8556956460 with a case # then gave me my social security # over the phone which is crazy in itself then said I was facing possible charges for stealing (not paying for items taken from store) and for not paying a debt to Kay Jewelers.  I told him this was BS and that if they wanted to serve me to come on..he became very aggitated and said for  me to stay off his line and go deal with my own stuff.  I believe this is a scam.

Similar to Tangela, I received a call from this fake company, Clark and Associates for a debt with Belden Jewelers. They first called my work saying they needed to serve me papers and if they could come down.  First off real processors do not call first they just serve you with papers.  I called the number this fake processor gave me and they said I owed money due to a debt from 2004, which I haven't received any letters or calls on since then.  The scary part was that they did have a lot of my info.  besides my work phone number they had my social security number and home address and phone number.  I told them I needed proof and they sent a fake letter to my email, not my home.  The letter head was under a lawyer named Edward T. Weber.  Although, he is a legit lawyer the company, Clark and Associates is not.  This company is not listed on his website and when looked up through yellowpages it is not available.  It is a fake company.  Also, on this letter it stated Kay Jewelers, not Belden.  After researching a few things I believe that Clark and Associates is part of this larger scam through another fake company called PCQ Associates and PLS Associates.  All operate out of the same area, have similiar phone numbers, and call people asking for money and saying they are serving papers and pressing charges if you do not pay.  The reason they have so many different names is because people are catching on to their scam and contacting the BBB, Attorney Generals of their states, and the FTC.  Do not be scammed, I almost was but thankfully the people around me helped me see what this truly is.....BS.
