    They actually called my brother saying that I owe them money and I don't know what they're talking about and when I try to call him there really defiant and then they threatened me and told me that I have to get an attorney

    No one calls and tells you they are going to serve you papers.  This is only a scare tactic. They would need to give you their full name, name of the company they are calling from, etc.
    Call your local attorney's office or the police dept and they will tell you the same thing.

    some gentleman from nationwide legal(wouldn't give me his name) called my job and told me if i didn't call 855-707-0167 immediately they were going to come to my work and serve me legal documents. i told him i'll be waiting and he hung up.  I have no idea what this is about because i do not have any outstanding unpaid debt.

    They just called my job and threatened to serve me papers. They stated that they had filed a court case against me in a county where I don't even live.  I called the above number back and asked them why they were violating both federal and California law and he got rude and hung up.  I just confirmed with my state's attorney general that what they are doing is highly illegal. He called them "zombie callers".  Since they can mask caller id, there's really nothing they can do about it.

    They called my cell phone, asked to speak with my brother who lives over 1,400 miles away. Stated they were calling from Nationwide Legal about a legal "investigation" and my brother needs to call them back 855-707-0157 immediately. She threatened legal action if he did not call. I told her to remove my phone number immediately and she stated that was not possible without my brother calling in the change of phone number.  The phone number displayed on my phone as NO CALLER ID when i answered.  TOTAL SCAM!!!!

    Yes, it is a debt collection extortion scam and your brother is their intended victim.  I would suggest that you have your brother read the following as well:

    One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them and they can scare that person into paying their extortion money.  They often call people that have never even been associated with you because they get erroneous information off of the internet.

    They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid. 

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

    I call these people after getting 7 calls in 30 minutes from them, I spoke to Alana who said she had a civil claim against me, I asked her for  her address and her full name and before she gave me any of the information I requested, she started yelling at me saying "NO!, you don't need my last name you can call me Alana,

    Me: ok, Alana can I have your address and she said, we are a legal service and we have a claim.
    Me: Fine I need a validation of the claim, your last name, and your address
    Alana: NO, you don't, you just want to send us a dumb letter
    Me: Ok, who are you? I need to know who you are before I can work with you,
    Alana: You don't want to work with us so I cant work with you have a good day! see you in court And she hanged up.

    She obviously did not like the fact that I wanted to know who they were, the only information I was able to get from her was her first name, they are in Orange County California.  I am in the same boat I was before talking to them, without a physical address and a copy of the "claim".

    I spoke to a person name James McKesson saying that I have a civil suit against me for a Company named "American Webloan". He stated that hey I borrowed money from that 4 years ago and are filing legal matters towards me.

    I asked if I owe this money why havent I received a letter or anything associated with this claim and he said "You wouldnt received a letter or anything". I said thats odd and then stated that all the information that he has given me is incorrect/no associated with me. I never had that email, account number, or even know of my company namef that. I also said that I will be contacting my attorney to give them this information of this false allegation. He said he could call him if I give him the number. I said no thank you, I have your information. I think this is a scam company trying to put false debt on people.

    Most likely part of the Premium Asset Services (PAS) scam.  See:  888-504-1003 800notes,

    Extensive group scam using names such as   Nationwide Legal Services and or City Services Group.   And other names as well.

    Now using Riverside Portfolio Management as their group name.

    Closest I could come to an address is:

    2781 W MacArthur Blvd
    Santa Ana, CA 92704

    Which is a "Shipping Center" outfit in Santa Ana.  Don't know the box number.

    Just another mall rat kitchen table debt scamming operation.

    More research is necessary.

    In any event,

    Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

    If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

    Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

    If they are bothering you, report them:

    Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question.  As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes.  The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question.  Most do not send debt validation letters and many often say they are collecting for someone else.  So, make the complaint anyway if they are bothering you.  Let the FTC sort it out.

    Also contact your local attorney general

    If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    You'll probably have to yell at them and talk over them.  Tell 'em  no scammy debt collector is going to push you around.

    You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking).   the only thing they understand.
