I keep on getting calls from a so called "James Andrews" saying that he is coming to my house to serve me with a court summons. He's been calling since monday 1/27/14 and supposedly he will be here today 1/29/14 with my summons. He wants me to call this 8557383974 number and I will not do it because it is a nasty debt collector!

"REAL" process servers do NOT call you ahead of time - they just show up!  "REAL" process servers also do not tell you that you have to call the debt collector - they just SERVE court papers.  BTW, you should advise your caller that it is a federal offense to claim to be law enforcement, an attorney or process server, when he's not.

When "James" calls again, tell him that per federal law, he MUST MAIL (do not accept email or fax) a debt validation letter showing that you owe a debt and that your caller has the legal right to collect said debt.  Refusal to MAIL the debt validation letter within five days of the first call is a violation of federal (FDCPA) law!  And per the FDCPA, you should NOT pay any caller who cannot or will not mail this documentation to you.

Follow the steps in what you need to know. A legitimate debt collector agency should not have a problem with giving you a real business name and address you can google and verify via google street view, BBB etc.
