- Randall Anderson| 4 repliesA caller called me and told me that charges have been filed against me, and that I should call a Noah Daniels at the number listed above, who will be the lawyer for the person filing a case against me. Also he could not identify what charges they were and that they were coming to my house to make arrangements for me to pay money to the person who filed a claim against me.
- Angel Fan replies to Randall Anderson| 2 repliesThis just happened to me today. Was there any truth to it or was it a hoax? It sounds shady to me, but definitely caught me off guard. Any information would be helpful. Thank you!
- CWG40 replies to Randall AndersonTotal scam. No legitimate process server notifies you in advance that you are going to be served. "Charges" are criminal actioins that are filed by local public prosecutors. Being in debt is not a crime and you cannot be arrested for it. Debt collectors have nothing to do with the criminal justice system or the filing of "charges." This is just an attempt to scare you into paying them money. Don't fall for it.
Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a DIME until the debt is validated.
Of course they won’t do this, no scammer ever will, so simply block their calls and ignore them.
If they are bothering you,
Report them:
http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening arrest or criminal process in order to collect a civil debt is a clear violation of the Federal Fair Debt Collection Practices Act)
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. You might have to yell at the scammer and talk over him or her. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now. - MJG replies to Angel FanHe refused to give information and made threats....would a legitimate company do that!??! Emails and phone calls mean nothing!
- CWG40 replies to Angel FanAlmost certainly a scam. See my note.
- Jacqueline Rodriguez| 1 replyI received a voicemail and was told to call 1-855-739-9586 and speak with Mr. Thomas he was the lawyer that will represent me in court. I told my husband to call first and he was told that there was case number that I was charged with stealing and that I had to apear in court next week. I called and who ever he is wouldnt tell me what court I need it to be and when I kept asking questions he got really mad and told me to wait for my sitation and I told him that I will bring my lawyer. This is sick!!!! Who ever is doing this should [***] off and leave us alone.
- Trish BurkePeople from this office are calling my family members and my former roommate. Saying that I am in big trouble. Funny thing is, I work for a company that required a full background check. If there was any truth to this I wouldn't be at my job. I want to know how to get them to leave my family alone. We are all sure that this is a scam.
- CWG40 replies to Jacqueline RodriguezTotal scam. Most likely debt collectors trying to scare you into paying them something. "Charges" are filed by local public prosecutors on the basis of police investigations. If you were charged iwth a crime you'd be aware of it from law enforcement in your local area. You would not hear about it by cold call from some scammery - scummery debt collector. This scammer is really stupid. No one can represent you in court unless you consent to representation. This Mr Thomas is no doubt a scammer of some kind.
There is no court appearance. You can check this out by simply going down to your local main court house for your country and asking the clerk whether or not your name appears on any defendants list. Usually the court clerks will be glad to help. You should also go down to your local police station and make a complaint of harassment by people impersonating pubic prosecutors.
