Got a call from an anonymous number but they left a voicemail with this number. Called back n they stated my husband owed bank of America from 2016. Amount of $6000 but they would settle for $2500. They did have his social security number and don't but he's never had an account with BoA much less good credit enough to ask for a loan.- Caller: Alliant acquisition group

If not by the end of day a motion for lawsuit would be filed Monday with the courts. Called hospital. Bill wasn’t in litigation. Too old.

- BigA replies to E. HawkinsIt could not legally be filed in court since the Statute of Limitations has run out in all but one state (Kentucky). However there is never a need to try to track down bills when a bill collector calls. You simply make them follow the law. It starts with this:
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- JohnIt showed as anonymous on the caller ID. They left this number to call back. In the message they asked for my wife, but the last name they used was a married name that she hasn't used in about 15 years. I'm guessing they are trying to collect on some seriously old debt that they can't legally do anything about. Not to mention we discharged all of our debt in bankruptcy many years back.
