I found out that I did indeed have a case filed against me in my home town for a bad debt. I was not aware of the debt and it was valid! So take the call if you get it.

- Elspeth replies to Kyle| 1 replyI call BS. If you really did have a case filed against you, you would have been served papers by a court process server or sheriff/deputy. If the police want to find you to serve you, they know where you are - even if you've moved!

- Castro replies to Kyle| 1 replySomeone from their office called my husband's employer several times and said they were from the sherrif's office. They verified if he was working so they can come serve him papers in an hour. Nothing was filed in court and no subpoena was ever issued. When I called the number to tell them that by repeatedly calling my husband's place of employment was in violation of the Fair Debt Collection Practices Act, they continued to call even more. When his employer called them back, their office said they do not make outbound calls and asked for my husband to call them back. This cannot possibly be an attorney office - an attorney's office would know what's not lawful (at least we all hope so).
- NicoleI received two missed calls (came up as private) so they went straight to vmail. First message was directed to someone other than me but the agent sounded mumbled. They called a moment ago, and was able to hear the call back number a bit more clearly. End result: they had the wrong number & thought my line (a cell) was a business. I've had my number for seven years. You'd think for a law firm they would do some researching....

- crystalI got a call 6 months ago and they said they were going to come to my job to serve me but never did so I called my lawyer and he said ignore it unless I was served. Now for the past few weeks I get a call once a week asking if I will be home during certain hours so someone can come serve me and I am always here but no one ever showed. So this last time I said yeah I will be here but I bet you dont show and they didnt. I got a call today from the 8558166857 number and it was a recording with a ref number. So I called and was put on hold then asked to state my name on record then my last 4 ssn. I said I do not feel comfortable giving that since he already knew and even asked if I was served and said I was not. So, unless I get papers I am going to let it go.

- Donna SettleI keep getting calls from this number stating they are James Black & Associates and they are representing Plain Green Loans and trying to collect a debt for them. They asked for a debit card number and threatened to have papers served on me if I did not give them a number withing 24 hrs

- D PerezThis is a scam. I received several phone calls over the last two days from a private number that refuses to provide their contact information and the name of the company they provided can't be found anywhere (Leo's Court Servicing Department). The caller was purposefully low voiced and hard to understand and they left this number for me to call as they are unable to locate me to serve me with legal documents. I checked my county court system for any cases filed against me and there are none. This type of scam was the subject of one the newsletter articles from the FL State Attorney General's Office. I submitted this latest one to the office along with a printed recording of the voicemail message the caller left.
They are hoping you will call them so that they can scare you into paying trash debts. They are not authorized debt collectors for your creditors, they are simply trying to make a buck by getting you to pay them as a third party. If you owe the debt, call the company directly and make a payment agreement if you are able to. They would rather you pay them instead of paying fly by night companies anyway.- Caller: Court Servicing Department

- AlfalfaThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
