They called from a (513) 456-4028, but said they were calling for a client about a legal matter. (855) 878-3366. Joseph Wagner said he was a legal courier.

Message left that he was a legal courier and would be serving me with papers at my home or work the following Monday. Was calling from 843-473-4168 but said he was a courier in my county (wrong area code of the caller ID if that were true) and if I wanted to find out why I was being served to call the attorney at 855-878-3366. I’m sure this is a scare tactic to extort money. The name he called me by is a name I haven’t gone by in 10 years. And who calls to tell you that you are going to be served with a summons? That just doesn’t happen. What a bunch of garbage.

Called on my cell phone and had the last four digits of my SS# - I hung up yesterday but he called again today and left a message. Said his name was Carter Mawell and he was a Courier for Orange County FL - same thing - wanted to deliver a summons to my home.

Same call except name was Carter Foster and said he was delivering court papers to me. It is my final Courtesy call he said. they don't call when someone has summons for you - they just show up.  This is a scam  EMG Company - never received paperwork in mail which they have to do -  also called on 909-200-3055

Said his name was Michael Davis from Cook County Cook and I will be served papers to my home about being sued for a loan that I've never taken out. He stated I could call 855 878 3366 the investigator and get more info. I called and a man stated he was investigator Aiello and I need to send $1106 to clear this matter up. I stayed to him first of back in year 2006 I never took out a payday loan for $2600 and give me the number the payday loan folks and he got passed off and said he can't do that and wishing luck and stated since I won't pay $1106 I will be sued for $6000. I told him to go right ahead. Have a great holiday sir he said same to me.

Let Cook County know.  It is illegal to claim to be a government employee - then www.ftc.gov ...state attorney general...and www.consumerfinance.gov .

In any event,

Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

If a voice on the telephone claims you owe a debt:

1.    Demand the person give you his or her name, company name, and address
2.     Demand a debt validation letter by US mail.  E-mail no good.
3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

If they are bothering you, report them:

Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question.  As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes.  The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question.  Most do not send debt validation letters and many often say they are collecting for someone else.  So, make the complaint anyway if they are bothering you.  Let the FTC sort it out.

If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

You'll probably have to yell at them and talk over them.  Tell 'em  no scammy debt collector is going to push you around.

You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking).   the only thing they understand.

As a legal professional (not an attorney), be careful with anyone that calls to tell you they are serving you with papers to sue. THIS IS NOT STANDARD PROCEDURE. In fact, when you are served papers, you are not warned or even given a phone call. The courier will just serve them without notice. It is also ILLEGAL to claim to be a government employee. It is also illegal to threaten you on a debt simply because the debt may not even be yours. The collection agency has the burden of proof to show you that you owe that debt. They must give you their name, address, phone number, etc (any contact information you ask for). If they deny you of this, you have the right to tell them to cease and desist. You also have the right to send them a C&D letter as well.

These scammers/collectors will hide behind the guise of attorney that is supposedly focusing on your file... like the Boogieman. BEWARE! Tell them to get lost and block their number.
