- BigA replies to MelissaYep, this is the ever popular right now "process server" extortion scam.
They will mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and have to be served within a certain amount of time. Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

They told the first party everything that has been presented to others on this site. It is indeed a scam. I shall be contacting the Atty. General's office immediately. Whatever you do, don't send money to anyone. I've had an ongoing problem with scanners since 2012. I had one tell me to go to Walmart and purchase a green dot card and load money on it. They gave me an hour to do this. After an hr. I didn't do what they demanded, and they called me back once again and said that I would be in legal jeopardy. I called their bluff, and the person who contacted me was absolutely furious. I hope no one will do what these scammers are demanding you to do. Do everything possible to protect all of your personal information..

- BigA replies to KayWell, your post is really hard to decipher, but I think the answer to what I think is your question has already been posted. I would suggest that you read it, and if you cannot understand it get someone to explain it to you.
- Angel MD replies to MelissaMembers of my family received the same scam message yesterday and today. I called the number to confront this company about this threatening call on yesterday. The associate I spoke with apologized; claiming it was an error on their part and that they would remove the cell numbers from their database to avoid future errors; but, those idiots called again this morning. This time I called and warn them if anyone in my family receive another call from them, there would be serious actions taken toward their company.....at which point the caller became unprofessional or very short with me; hung up. Friend, I suggest that you simply block and report them if possible. Don't p/u or give any of your personal information out to strange callers that you don't recognize or expect. If the call is important enough they can leave a message. This way you have an opportunity to review the number ( google it) and determine if it's a scammer. Unfortunately, phone/text line communications are jammed with scammers and hackers; so be extremely careful when using your phone. I know this sad news, but it's reality of how evil things have become our world. Take care!
- annonymous1my family has been receiving phone calls from this number telling them that I am going to be documented as avoiding them and get a failure to appear in court, It is this same number every time, I have called, no one ever picks up. There were two phone calls made today to my family members, my niece was called the other day and they told her I am being "investigated" for something. Again, I called no answer. How did they get my family's numbers is what I would like to know..... also what can I do to make them stop?

- TLAHave been receiving calls from both UNKNOWN CALLER and 512-652-2161 leaving this number as the callback. A man identifying himself as Joe Williams leaves a message in a threatening tone, using a full name repeatedly. Indicates by name the street name of the home, a place of business and that street name. Says that he is on his way to serve papers, tried to serve papers, will be serving papers. Indicates a specific time for this. Says that a manager or work supervisor must be present at the place of employment to witness this and that I must have 2 forms of STATE ID. Tells me he will report me to the "proper authorities" if I'm not there and that this will turn into a "refusal to appear." Leaves the 855-883-8926 as the phone number to call to take care of this with the a case number so they can put a "stop order " in place. So I called. Cause the thing is, not only am I NOT the person that they're calling, I don't KNOW the person that they're calling. Same exact guy answers without identifying himself or his company. Asks what I'm calling about. I give him the case number. He asks if I'm First Name Last Name, I neither confirm or deny. I ask him who he is. He says his name is Steven Leverman. I ask what company it is. S & S services. I tell him he called me and I am returning the call. He says they do not make "outgoing calls" and I was called by someone serving me. I tell him that I was called by a spoofed phone number. He says he's transferring me to "pre-litigation." SAME EXACT GUY picks up and gives his name as David Silverstein. I do the same thing with this guy. I tell him to stop calling my number he repeats that they don't make outgoing calls. I tell him obviously they do, point out the myriad ways in which this is a scam (a process server trying to schedule a time, the demand for 2 state IDs in order to be served, the need for a witness, the threats to report, etc.) not to mention that I'd gotten this far into the phone call process without him once attempting to confirm that I'm actually First Name Last Name. Oh, and that Joe, Steven and David all have the exact same voice. At this point he begins screaming at me, insisting that I AM First Name Last Name (for the record I am totally NOT, pinky swear) and on and on and then he hung up. I immediately call the 855 number back and he answers with "David Silverstein." To which I begin laughing, he shouts obscenities, and he hangs up. So in closing - call and ask for David Silverstein.

- Cam replies to CarolynWe had virtually the same phone calls today. Sounded urgent. And we were so upset for daughter. She alerted us to scam, which relieved our minds and taught us something important. No money exchanged hands in our case. But we panicked, until realized scam. Sounded legitimate.
- Vicki D| 1 replyI've been getting calls from this number on a continual basis. A man claiming to be 'Joseph Williams' continually calls me at home and is now calling me at work. He used to say that he was coming to my house to arrest me and now he's leaving messages that he's serving court documents. He told my boss (while I was on vacation) personal information about me and claiming that I had a court date. He told her that he came to my home but I was not there. I'm really getting sick of this. I would like to take legal action now. I have his voice on my voicemail and will be keeping future calls saved for legal use.

In any event,
Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.
If a voice on the telephone claims you owe a debt:
1. Demand the person give you his or her name, company name, and address
2. Demand a debt validation letter by US mail. E-mail no good.
3. Do not pay the collection agent or anyone else a dime until the debt is validated
Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.
If they are bothering you, report them:
http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening civil proceedings with no intent to follow through, or threatening criminal process in order to collect a civil debt is a violation of the Federal Fair Debt Collection Practices Act.) The same goes for endless telephone harassment
Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question. As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes. The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question. Most do not send debt validation letters and many often say they are collecting for someone else. So, make the complaint anyway if they are bothering you. Let the FTC sort it out.
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.
You'll probably have to yell at them and talk over them. Tell 'em no scammy debt collector is going to push you around.
You have to get tuff with these people because, being akin to thugs, brute force is (metaphorically speaking). the only thing they understand.
