- BigA| 1 replyCounty clerks do not call people to tell them that they are being sued. It isn't their job.
The fake process server/location finder extortion SCAM usually consists of the following:
They mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency. They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). They threaten to serve you at home or at work. They tell you that if they serve you at work then they will need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work. They also tell you that you will need two forms of ID. None of which is true. Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else. They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”. Court documents are time sensitive and must be served within a certain amount of time. Remember that you can always call the local courthouse to see if there really is a lawsuit that has been filed against you.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

- LRB| 1 replyI recieved a call from a private number, when I didn't accept the call they called 5 more times in a row. I finally answered because I was sick of the calls.
They told me they were a process server, for an attorney Michael Harris. That they tried to serve me papers but I was not at that address. They said it was for a credit card; that I never had; and that I needed to appear in court.
I called multiple courts, statewide not county, and no such case exists...anywhere.
I called them back telling them their # showed up as a scam upon searching and they blocked my number from calling them
Called a real process server in my area and she said this was a scam that is going on.- Caller: 855-926-1728

- BigA replies to LRBWhen you are sued for a debt you must by law be sued where you live and not in other courts. Everything else that you need to know was already posted.
- KJSame as above stated! Received a call stating they were a process server calling on behalf of Michael Harris and that they tried to serve but the address on file wasn’t able to be served at. And to call the 855 number and give the case number,

- Joe LunchboxReceived multiple calls from an “Unknown” number in a row before I answered around 5:40pm. A person claiming to be a representative for a process server informed me that they were looking for [my real name] and that they had attempted to serve me at [my real address] multiple times in regards to a civil manner. I know I’m not being sued, and I know process servers don’t call from unknown numbers and informed the caller of this. He then told me it was for “security reasons” and that I could contact a lawyer, Michael Harris at 855-342-0640 and provided me an eight digit and two letter “case file”. A quick Google of said info led me here. I called the 855 number and reached an “away from my desk” message upon which I left a message informing them to “not contact me further with this scam”.
- Caller: Michael Harris
- Barbara Mautz| 1 replyI got a call from a unknown number and this isn’t the first time they have called be stating they sent some paperwork to the address on file I spoke with this person before and it is a scam about a debt from 1994 and they actually had all my information from my current cc and whom my family members are they actually called my daughter and mom. This is out for control. I spoke with a lawyer in my state it is illegal for them to call about this and it’s also a bogus case number. Wtf.
- Caller: Someone from Tracy Williams office

- Barbara replies to SWWI’ve gotten the same message as well. Scam. This is ridiculous. They actually called my daughter and mom. With the same bogus message. The case number is bogus.
- Tygerkat replies to Barbara MautzIf they have your credit card number, make sure there are no fraudulent transactions on it then cancel it immediately.
As for their calling family members, they're trying to embarrass you into paying them. - TappLaurie Collins an investigator contacting me on behalf of the state location unit. These charges are pending against you in LA County (Have no clue where that’s at ) call back at 855-926-1738. Ref case# given.

- I.H replies to VJC| 1 replyThe same here but was for my brother who passed away a number of years ago.
- Susie S. replies to BigAI received a blocked call from a female "Process Server" who was trying to serve me with a legal suit but stated paperwork was rejected by the mail office and returned to her. Her voice was polite, professional and well-spoken. When I asked her for more information, she told me that the documents were sealed and did not have access to more information. She provided a phone number (1-877-643-0716) with a claim #: 3133956CV with Attorney Michael Harris. I called the number and when I asked where I was calling, the woman, who was rude and abrupt, said it was a answering service for a group of attorneys. When she asked for the claim number, I told her I did not have one and she abruptly said "then we have the wrong person" and quickly hung up.
1st - a server will never call ahead to alert you that you will be served.
2nd - the phone number should not be blocked
3rd - the "answering service" will not disconnect the call just because you say you do not have a claim number. She would attempt to keep you engaged because after all, it behooves the "attorney" to serve you the paperwork. It is a legal right.
This is definitely a scam. I consider myself very aware and not easily fooled. But this time, I was caught off guard with the first caller who was very professional, calm and well-spoken. However, what gave her away was her last statement "please make sure you call because you do not want to miss out on anything" Not quite the words to use.
