- Angry Individual| 3 repliesThey called and told me I owed on a payday loan from 2012. Said it was check fraud using collateral of a closed checking account but the last 4 numbers referenced were my current checking account. Told me I had been avoiding their attempt to serve me papers since then but the current address they referenced I have been at since 2013. They said they would settle my original $350 loan that was now over $1,700 if we paid $1,000 now. I had them email the letter to my wife and she investigated and found it to be a scam.

- Marie| 1 replyGot a voicemail with a robot using my maiden name , then switches over to a lady saying this is the last attempt curtiousy call from Marisa Collins about me not being cooperative about the pending claims against me. They called with a number from my area code so I'd answer but left the 866 number. First and more most when they call using your maiden name when you been married that's just flat out red flag.

- Cindy| 3 repliesthey called me Friday saying I had 4 payday loans from 2010-2012. He stated funds came back so they were going for criminal charges. I asked to have stuff send, they refused. If charges would have been from 5-7 years ago, wouldn't I have heard something before now? Called today to get stuff emailed to me, they stated it would be in my court papers. So not sure if this is real or not???

- Cari replies to CindyScam!!!!! I talk to a police officer I know and had him listen to my message that was very similar to what you have explained. He laughed and said there is no way it's legit!
- TedScam. Do not send these scammers any money and do not give them your bank info. Their threats to serve papers or take you to court, have you arrested are just part of their scam to scar you into giving them your money or bank info. These people are not legitimate - if they were a real debt collection company they would know the law states they must send you a letter with information of the original creditor and amount owed with the option for you to dispute the debt within 30 days. These scammers call and use extortion tactics to get you to pay over the phone that day.

They use threats to get you to pay over the phone without even giving you proof that the debt is yours or valid. This behavior is against the law from debt collectors - but they aren't real debt collectors, they are scammers looking to get quick cash/bank info from you over the phone. - Terry .| 1 replyThey called me and left a voicemail saying that this was my last chance to comply with a delinquent account. It seemed legit until they told me the account was from 2012, but the company that they said I was working for when I took out the loan was not correct. I didn't start working for that said company until the end of 2013. Plus the .address they said that I submitted on my loan was my current address, which I also did not move to until 2013. They try to talk really fast and try to get a quick payment from you. Always tell them to send you paperwork and make sure the dates and everything matches up.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: http://www.consumerfinance.gov/

Then Marissa Collins came on and said this is the final attempt. Definitely a scam. They even called with the number from a local Sheriff's department and then left a message with the 866 number. Not to mention the address they have is an old one and if they were a legitimate organization they would have my current address. It was nice to see that I wasn't the only one getting harassed.
- LilyThey first called my boyfriend who I have no idea how they got his number and told him I had to call, when I called them They telling me I had a loan from back 2012 and wanted me to pay 2700 I told them I never took out a loan and they gave me my social number in full along with my current address which I just moved into a couple months ago... zack said that he would be able to lower this for me and put me on hold came back saying that he was able to lower it for 2000! But that I needed to pay 500 by that same day I told him no that I was going to call Bank of America which they were telling me that all this was because of Bank of America and when I said that they kept telling me no not to do that thatbthey had nothing to do with the loan I got which made no sense at all... I didn't pay them anything googled the number turns out it's a scam!

- MarieThey called today to my bf number looking for me, my name and address wasn't correct. The loan they said was from 2011 and said I needed to pay 460.91. When I asked for the information to be mailed to me, they said sure but it would now be 3715.89 from the district court. I said perfect I will wait. I knew this was a scam due to the unprofessional manner Marisa Collins and some man were demonstrating. I did report this to the Attorney Generals office too.

- ArtherCalled my work cell; have no idea how they got that and said it was an attempt to collect a debt to payday loan. He gave me the name of Tyler Gibson and that I had not responded to any email's or correspondence to my address which I have been at for over 3 years. I've had the same email address for over 20 years. I was told they could settle a $900 and something debt for only $700 something which I declined. He said he would email me the notice with all the information as soon as we hung up too which I have not received a thing since and that was over 3 hours ago.

- CWG40 replies to CindyIt is a scam. No debt collector has anything to do with the criminal justice system. In any case being in ordinary civil debt is NOT a crime and you cannot be arrested for it. We do not have debtors prisons in the US. Total scam, ignore an block the calls.

Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question. As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes. The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question. Most do not send debt validation letters and many often say they are collecting for someone else. So, make the complaint anyway if they are bothering you. Let the FTC sort it out.
Also contact your local attorney general
If they continue to bother you, and you know you do not owe any money, tell them that you know this is a debt scam and that you are making a complaint to the police for extortion. Once you get a copy of the police report and they call you again , just read out the file number and the name of the PD or Sheriff’s office involved. Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

You have to get tuff with these people because, being akin to thugs, brute force is (metaphorically speaking). the only thing they understand. - resovled replies to Angry Individuali thought it was a scam to. i googled there number i read all of your comments on here so i called them back got there information to report fraud to my local sherriff. sherriff contacted them and spoke with them. later on the sherriff informed me that they are legit so i set up payment arrangments with them to close out the case.
