- HeavensSunshineI received a call as everyone else has on yesterday. The recording said it was the office of Joseph White looking for someone with a different first name but the same last name as I. Threaten to come to the person's job or their residents to give 'service of process". I guest he thought using such terminology or the word "lawsuit" would scare someone in pressing the button to connect with him or to call him back. It appears to me that whoever this Joseph White is, he has either stolen a customer list, a customer delinquent payment list or brought write-off's from a company and trying to collect but only have the name of the person and how much they owe to try to make a profit on the back-end.
I had that happen to me before....After being seriously injury in connection to a job related injury; I received a letter in the mail that I owed a debt. I called the company to see if my account that has been closed for years had been sent to collections. I was given the companies name, but it was not the company who contacted me. In fact, I was told that since that time they had written the debt off/charge-off and that the debt was no longer owed.
Doing this same time, another person contacted me who had filed against me in court for an outstanding debt, and tried to settle out-of-court, but because I knew the amount was incorrect, so I decided to go to court after finding out that the debt was sold, but the company had no name of to whom it was sold. After going to court, the judge sent us in the hall to try to make try to determine the debt and make arrangements to resolve the issue, which we did. HOWEVER, when I got home, I noticed that I had the guys legal pad, which was identical to the one I had...he mistakenly grab my note pad, leaving me his. I was shocked to see that this guy just had my name and a $ amount next to it, alone with several others same scribbled on the paper with an $ amount. Very unprofessional and clearly, this guy didn't even have account numbers....just names and amounts.
I learned from that time, that if I ever have someone call me for a debt to force them to go to court and force them to should documentation and details of the debt, like my signature, ss#, etc., because even though I may owe, it doesn't mean that person is allowed by law or by the company to collect it. Also, remember, if someone filed against you, you have the right to go to the court before the court date and get a company of the filing to see what they used to request a hearing....many times, it's nothing more than them saying..."They owe me." If you owed someone, they are likely to submit that detailed information of you owing to the court instead of waiting to go to court; and if they wait, make them prove it, otherwise, you will have the burden of proof that you do not owe it. Always keep you record, even if you paid something off, even if you just keep the initial bill and the final payment...never throw away payments. If you make monthly payments somewhere, get a copy of your account ledger each month to make sure your payments are being applied correctly and no other charges are being added without your knowledge......keep those as well.- Caller: Joseph White

- Melissa replies to Anonymous| 7 repliesI too received a call from this "person" I called back and they had a lot of my personal info, even called my husband at place of employment. They were threatening court, charging me with theft by deception/fraud and wanting fees of over $4000 for a loan I supposedly never paid on 6yrs ago for $300. When I said I couldn't pay it they then said well let me see if we can get it pushed back to collections. She came back stating that if I could pay half of the original loan amount today then I could avoid litigation.
I'm confused whether to pay....especially after seeing all these comments occurring within the same time frame that I received the phone call. Seems quite odd - JamesDon't know these people

I called the bank I never got a loan. I'm lost on what to really do, I don't need and sheriff showing up at my door step. If any one had any more info, my email address is cubsfan197738@gmail.com.

Criminals masquerading as debt collectors attempt to extort money from people by scaring you into believing that you will be criminally charged (they use the bad check or hot check claim a lot) and go to jail, lose your driver’s license, have wages garnished without actually being sued or going to court, be sued, and a variety of other variations on this, all for an alleged or nonexistent debt. One of the tricks they use is to call your family, friends, neighbors and/or places of employment (past or present or both) to create panic and embarrassment so that their intended victim calls them and they can scare that person into paying their extortion money. They will use the words “Mediator”, “Arbitrator”, or “Law Office” to make you believe that they are something other than a debt collector want-a-be and that they don’t have to follow Federal and State collection laws. They do have to follow those laws, but they won’t. They mention that they have received a Fax document, to create the sense of urgency. They also tell you that if you fail to call them back you are "waiving your right to council", which is pretty much nothing but hogwash. They also use the “process server” ruse who calls and claims he is going to serve you, but then says you could avoid it by calling another number where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer). Process servers do not ever call ahead so that you can dodge them. Process servers get paid to serve papers, nothing else.
If you feel you SSN has been compromised, in addition to putting a fraud alert at the 3 credit bureaus, you may want to notify the IRS. Here is the link, fill out the proper form (probably 14039). Also file a report at the FTC Identity Theft web site as well as learn what else you need to do:

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
