- L| 2 repliesAntwon Davis called me and left me a message from a blocked number. Stated he was near my house about a block away but could not locate my home. Weird, because any GPS or mapquest would take you to my front door. He further stated that he had a court summons for litigation against me. That if I could not reach him I could go to the court house in Broward to retrieve the summons. Failure to reply to the summons may result in a Failure to Appear warrant. So let me help some of you out with this type of situation as I was a police officer for 10 years. 1. You will never get a FTA warrant over a civil litigation, (ie debt). Credit collection agencies will use this type of tactic to scare people into calling their number to be berrated into paying a debt. Regardless if it's $100 or more. 2. Civil litigation is not a criminal offense. Do not allow someone to tell you otherwise. A debt collection is simply a civil matter and not criminal. I have a small amount in rearage due to an account in both my name and ex wifes name. Probably about $250. I could pay it but honestly, why should I? After about 5/6 years it will not show on your credit record. It gets removed by law. The debt collectors may continue to reach out and attempt to collect. The reason why these collectors get so aggressive is simply because they make their money based on collections received. If they do not collect on behalf of their companies they do not get paid. Somewhat like commission. Kinda slimey to scare others with no law knowledge but they use that to their advantage. Afterall, a debt is a debt. I know of a woman that owed about $500 and she was threatened with a Felony and extradition etc if she did not pay by the end of the day. She paid them $1100 which they stated was their interest and attorney fee's. What a shame. Attorney fee's was obviously a rouse, however that additional money was the upsell of their commission for doing their jobs. The only time you need to worry about a court document is when a Sheriff's Deputy or Police Officer depending on jurisdiction is serving you a legal court document. THAT IS THE ONLY TIME TO WORRY! Even then, some agencies do process serving for a fee. If you need a court date to be given to a person, (ie think divorce etc.) it has to be legally served by a law enforcement representative. You pay for that service in part of the divorce filing if you do it yourself or your attorney does it for you with the cost you pay for their fees. Anyways, don't let credit collectors harass you. Do pay your debts when you can to avoid this. BE SAFE!

- JulieThese people actually called my 80 year old parents about me and left a message that they tried to deliver a summons to me and that I wasn't home. They left a message that said I needed to call them or get down to the courthouse the next day by 9:00 am or a warrant would be issued. Needless to say, they scared my parents half to death. I am furious with these people. My parents can't handle things like that. What can I do to stop these people from bothering my relatives?

Said he needed me to call their 866# to give them an apartment number so that he could deliver the summons. We don't live in an apartment. This stinks from the head.

Somebody claiming to be ME, called one of my after-bankruptcy clients, That impostor, told me client, that bankruptcy did not cover payday loans, and that my client needed to make a payment to Recovery Services at this phone number. client set up a payment--and then thought better of it; talked to my office, and managed to cancel before the money went out.
A breath-taking scam. Probably works most of the time. and obviously wire fraud and extortion. I advised my client to change bank accounts; and to report them to the FBI.- Caller: Recovery Services

I received a call from my local court house saying I needed to appear before 9:00 am ... Court house closes at 5 , this call came at 6:30 . A gps takes you straight to my house ... And now it's September 22 still no papers. So every time I call they hang up on me or I get he's recording message. I have left many message for a return call.and nothing. Well I have be had. It's bad this people is out here taking innocent people money.

- CWG40 replies to chatmonIf you paid by credit or debit card go back to the bank and see if you can reverse the transaction because of fraud. If someone calls you claiming a debt require that they send you a debt validation number which must be sent by US Mail. E-mail no good.

Gunnar - Nick| 2 repliesI received a call today from an Antwan Davis left me a message and said he had been at my residence and named my address. He told me I had 2 choices either go to the courthouse before 9am to avoid my summons making it onto the docket or to call a number. If I failed to do so would result in a missed court date. Mind you he called me from a blocked number. I called the number he gave me 866-473-6899. I talked to a "Scott" and he told me that I had to pay him righ then and there for a payday loan that I bounced a check with or I would have criminal charges filed against me. I told him that I could not pay right then and that I would have to do so in the morning. He told me he only took debit. I asked if it was a scam and he said no that rest assured any scammer wouldn't take visa or mastercard that if they accepted either of those it means they are legit. I put him off so that I could investigate this further and I am glad I did. I cant wait to cal this scumbag in the morning and screw with him. He said he was from Regional ACH services. Last I knew process servers didn't call you. They just serve you. They also don't let you know they are looking for you. [***]...

Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.
According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.
The fraudsters relentlessly call the victim’s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims’ relatives, friends, and employers.
