- Carol| 3 repliesDefinitely a scam! Same scam I got a year ago but with a different FAKE company, Johnson Smith and Assoc.
- Caller: Johnson Smith & Associates
- Call type: Scam suspicion
- K| 1 replyCalled me numerous times but I didn’t answer since it was an unknown number or blocked caller. They also stated calling my Father, which scares him. They stated that I had a legal matter and they needed to serve me papers and I had until a certain time to respond or they would have no other choice but to file a suit. I do not have any credit card debt nor am I delinquent with any of my bills. I actually work for a law firm, so one of my attorneys called on my behalf, yet they made an excuse that the person I needed to speak with was on another call. I then personally called and the same man answered the phone and told me that I was a fraud and tried to petrey myself as an attorney. And then said he looked up the “so called” law firm I worked for, which, if he did he would have seen that it was lagitament. Sorry this is so long winded but this makes me so angry. This is 100% a fraudulent company. All they are trying to do is scare you to make you think you need to pay them money to make some fake “legal matter” go away. Do not fall for it.

Jsmithassociates.com - BigA replies to anonYes, it is a scam, one that has been outed here many times. But then you know that already, since you are here to shill for these crooks. But thanks for letting us know they are also scamming people using this number as well.
- BigAI would be willing to bet that if sent a certified, return receipt letter that it would be returned as undeliverable.
You will need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested). Also send it first class mail in case no one will sign for it. Make a notation of that fact at the bottom of the letter. You also need to report them to the proper agencies to which I have provided links to. Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment. If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it. Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front): http://www.consumeradvocates.org/

Everything else you need to know follows including at least two agencies where you should report their criminal activities.
JOHNSON, SMITH & ASSOCIATES AKA JS&A
Website says they are in Massachusetts: http://jsmithassociates.com/index.htm
Website was created in March of 2017 according to Whois.
The BBB has no page on them under that name
The address is a UPS store, but another criminal debt collector by the name of Receivable Management Corporation aka RMC is listed at that address with a “suite” number
They are not registered under that name with the Massachusetts Dept. of State or registered as a debt collection agency, which legally preclude them from doing business.
Other complaints:

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.
List of State AG’s offices: https://800notes.com/faq/attorney-general
Also file a complaint with the Massachusetts Consumer Affairs and Business Regulation: http://www.mass.gov/ocabr/government/oca-agen ... -complaint.html
And the Massachusetts AG office: http://www.mass.gov/ago/ - Mr. Doe replies to CarolThe address on their website is a UPS store in a strip mall! How pathetic! You would think these losers would just get a job like the rest of us. Obvious SCAM!
- Resident47 replies to KYour suspicions are correct. Rude demands to "pay now before we sue" and simulation of legal process, while refusing to send paper mail or justify debt claims, is not how the CFPB and FTC want debt collection done. I would pay high admission to watch your employers verbally b-slap JSA's fake lawyers in court, for real claims unlike the phantom case JSA keeps threatening.
Your comment length is not an issue but it would help to calmly proofread before submission. "Lagitament" and "petrey" are not English words. I'm guessing "legitimate" and "portray" were intended respectively. Let's leave the keyboard mashing to the shills like "anon".
