I cannot stand these calls ... we have inadvertly sold our lives to the internet by simply joining  Facebook or buying a book from Amazon! Every time we data any site with our own info we can never be sure of privacy. This is opening a whole new animal of Virtual rights and laws. Imagine the implications! WE screw up our governments and now we are screwing up the link to the inner world of socialty and cyber violations and crime!  ugh!

Getting these calls from Transworld about a medical debt for my wife---recording stating to call back Wendy Higgins.  My wife called back and as someone previously stated sounded very 'ghetto'-- like some women lying in bed taking the call.  Bottom line is that we have no medical debts.  I remember taking this call last year around the same time and then they stopped.  How do you report and stop this obvious scam???

This company is Transworld Systems.  It is a collection agency, not a law office.  They can threaten to sue all they want; but none of the members of the leadership team are lawyers, so they would either have to have an attorney on staff or retain outside legal services to pursue legal action.

Here is what you need to do.  When this company calls you, BY LAW, you are entitled to a written verification of the debt.  In fact, if what I just found online is true, this written verification MUST be provided to you within five business days of the initial contact.  (http://www.fair-debt-collection.com/searches/verification-of-debt.html)  If you have not received anything from them without requesting it, you can politely request that they provide you with written verification of the debt.  I believe, once you do, they must stop contacting you for a period of time to allow you time to receive and review the verification they send.  You do have 30 days after initial contact to make this request, though I have made the request after the 30-day period and have been provided with the documentation.

Once you have this written verification, you can ascertain whether or not it is a legitimate debt.  If it is, you can either make arrangements with the collector to pay it, or can send them a Cease and Desist letter - this notifies them that you do not wish any future communication from them and as soon as received, they are bound by law to comply with your request.  Usually they will notify the original creditor of your wishes and the original creditor decides whether to take the debt back or pursue legal action.  If the debt is NOT valid, you should send a similar Cease and Desist letter which states that you have no knowledge of this debt and believe it to be erroneous.  ALWAYS send these letters via certified mail, return receipt.  ALWAYS.  Cover your you-know-what, because if you don't send it certified, they can turn around and say they never got it...and you will not have proof that they did.

I never deal with third-party collectors, because I've had issues in the past with them not properly notifying credit bureaus of the status of a debt that was paid in full (they marked it as "lesser amount paid" or something to that effect).  I always exercise my rights under the FDCPA, and I suggest that everybody look the FDCPA up and know it.  (http://www.yourcollectionrights.com/)

By the way, if they do claim to be a law office, they are in violation of the FDCPA and you can file a complaint.  You can also sue them if you so desire.  The FDCPA clearly outlines what debt collectors can and cannot do; and one thing they cannot do is falsely claim to be an attorney.  In a reply to this post, I will provide some information from the second website I referenced above.

The Fair Debt Collection Practices Act (FDCPA) has a set of rules that determine what can be termed as harassment by the debt collector. Harassment can be either written or verbal. Calling you repeatedly at home or work place is a form of harassment. Harassing in any form is considered a severe violation of the FDCPA.

According to the FDCPA the following are considered violations of the Act by the debt collector:

    Harassing by calling repeatedly
    Threatening to use violence
    Using obscene or abusive language
    Calling at work place
Calling after you request him not to call
    Calling but not giving name
Sending notices that look like court notices
Publishing a list of consumers who have not paid
Trying to extract payment over phone
Giving false identity of being an attorney
A debt collector can call you if there is a genuine debt to recover. But debt collectors are often over- enthusiastic and may end up placing too many calls or end up using tough language. This is considered to be harassment. The FDCPA punishes harassment by debt collectors. The Act gives out specific guidelines on what is considered unlawful behavior. These guidelines protect consumer rights.

If debt collectors obey the rules of the book the emotional stress faced by the debtors can be avoided. In the absence of this understanding there is a possibility of the consumer falling into the emotional trap.

You can avoid the harassment by following these simple rules:

    Stay calm during the call
    Do not enter into argument
    Do not use foul language
Do not give away your bank details
    Ask for debt valirom dation
Send a cease and desist letter
    Dispute the debt
If the debt collector has harassed you and violated your rights, you can sue him. You may engage an FDCPA attorney who will take care of the legal aspects.
