    Saying that I borrowed money in 2012 and didn't pay it back. They said I borrowed from the Indians. And the Indians want there money now or I am going to prison. They want $ 2000 now. Is this real?

    Sounds like a Western Sky cash advance if their talking about indians. I'm not sure about going to jail but I do know those loans are legit and follow different laws, and you can call them to verify your account information - 866-590-2274 that's the number from Google. I got garnished a few years ago, in [***] TX because of one i had taken out through them, and we don't ever get garnishments unless it's government related(Taxes, Child Support, etc). I'm not sure about going to jail though but I guess it would just depend on the circumstances, idk. I'd talk to your lawyer though. I just wish I wouldn't have thrown out the settlement letters as junk mail bc i ended up being garnished over $8000 and they would've let me settle out for $3500, but i thought there was no way they could garnish me so i just ignored everything :( I haven't taken out another cash advance since, and won't EVER do it again. Definitely not worth it.

    It's a scam, always a scam.  These people have to notify you in writing, phone calls don't cut it

    What they claiming is under federal bankruptcy. Per my bankruptcy laws they are scams, and scums. Plus once a fed depth is forgiven they are breaking law by contacting me. Now they are calling my family too? Got to stop

    Scam from a collection agency. They call from a private number then leave a call back number. They left a message saying you have a civil complaint file with the local county. I think I will wait to be served by my local county Sheriff's office. I think Santa Claus will bring me a new Lexus for Christmas first. Not sure how these scammers come across people to harass. Maybe old debt that is bought and resold. Best bet is to not respond and block private calls.

    Got a call from chris sanders ststing i would be served a summons and that they got a civil complaint against me..but evrything days scam and my lawyer said they dont call prior to servjng s summons and everything should be in writing.so idk

    If you have a lawyer, listen to them and you will be fine. They are right, Process Servers do not call in advance to serving a Court document.

    There was a simple, free solution to this.  All you had to do was to call your local courthouse and ask them if a civil complaint had been filed with you as the Defendant.  You can also ask them, what the local Rules of Civil Procedure say about service of said complaint.  The answer to the first will be no, and the answer to the second may preclude service by private process server.

    BBB has seen a major increase in collection agencies setting up businesses in the Upstate New York area over the past several years.  In an effort to keep consumers informed about which collection agencies are operating in accordance with Federal Law,  we are asking for specific information from all collection agencies operating in our service area.  The requests includes the following:

    :Proof Of Licensing, bonding and or registration by the city, town in which your business is located.
    :Proof of licensing required by any state in which you operate by mail or telephone or email.

    This collection agency has not responded to our requests.

    BBB advises consumers to be aware of their legal rights in regard to collections.  The Fair Debt Collection Practices Act is a statue enacted in 1978 which seeks to eliminate abusive and harassing behavior by any debt or collection agency.  The act states specific practices and rules under which debt collectors must abide by.  There are penalties for agencies found breaking these laws.  Some of these laws state that a collection agency is forbidden to harass a debtor, which includes threatening violence or legal action.  They may not use crude or offensive language or identify themselves as anyone other than by their business name.  If a consumer believes a debt or collection agency has violated any of the FDCPA laws the BBB encourages them to file complaints with the BBB at bbb.org and Federal Trade Commission at ftc.gov.

    Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

    If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

    Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

    Note that the US Supreme Court in the Case of HENSON ET AL. v. SANTANDER CONSUMER USA INC., has recently ruled that the provisions of the Federal Fair Debt Collection Practices Act do not apply if the creditor owns the debt in question.  As a practical matter this probably won't effect the kinds of scam debt collectors who often show up on 800notes.  The scam collectors don't give you any information about themselves so it is impossible to know whether or not they in fact "own" the debt in question.  Most do not send debt validation letters and many often say they are collecting for someone else.  So, make the complaint anyway if they are bothering you.  Let the FTC sort it out.

    Also contact your local attorney general

    If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    You'll probably have to yell at them and talk over them.  Tell 'em  no scammy debt collector is going to push you around.

    You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking).   the only thing they understand.
