    Legitimate process servers do not call to warn you, or to get money from you to stop the process.  They will deliver the notification without warning.

    Click the "Confuse" link, below, to learn how to validate the call, or confuse any "process server scammer"

    Confuse
    If you want to confuse any "process server" scammer, or validate the information, ask these questions of the caller:

    • What is the name of the person or company suing me?
    • What is the reason for the suit?
    • What is the name and address of the issuing Court?
    • What is the phone number of the District Clerk's office where this process is registered?

    Then, check those answers against the real District Clerk info you find on the Web, for your County.  Or, ask the County District Clerk to tell you if you have a process being served.

    Click on the "More Info" link for lots of good information

    More_Info
    (Here is more info than you really need on process serving:
    http://en.wikipedia.org/wiki/Service_of_proce ... nited_States.29 )

    Even more info:
    http://www.bbb.org/blog/2012/03/beware-bogus-process-servers/

    Also, if you were threatened with an "arrest warrant" via a phone call or email, read this:
    http://news.uscourts.gov/warning-arrest-warrant-scam

    "The warrant is phony. A valid warrant would not be served by fax or e-mail. It would be served in person by a U.S. Marshal or other law enforcement officer."

    "Anyone receiving a fake arrest warrant should contact the FBI or the district U.S. Marshals Office. If there is any question regarding the authenticity of a warrant, contact your district clerk of court."

    Definitions, if you need 'em:
    • A summons is an official notice of a lawsuit. It is given to the person being sued (the defendant).
    • A subpoena is a court order. It requires someone to come to court, go to a deposition, or give documents or evidence.
    • Papers or documents are words sometimes used by scammers, as scare words.  Legal documents can be sent via Certified mail. A courier is not absolutely necessary, although  the Sheriff, Constable, or a Bonded Licensed Process Server might be used.  Such people will have appropriate ID.

    caller ID says Employment Tonight....yesterday it was 866-315-8234 Luke Gallows....today 866-317-9450, Luke Gallows......called yesterday and got same voice- different name, played along and he was going to email me proof and call me back. Never came so I called back this morning and told him I can play the recording of him saying he would follow the law and provide proof and  my Uncle, who is a Federal Attorney in Washington monitored the email all day and nothing came in. He questioned why I recorded and told him in Nevada I can do that legally so he said he would put in another call for the proof to be sent and call off the people looking for me. Questioned why they are the only company that will let you know when to be ready to be served, told me they want it resolved. Also asked why nothing was mailed to me, which is the legal way to go about collecting a debt and no answer. Now that I have 2 numbers, I am going to call and harass this piece of crap everyday. Getting same calls from IRS collectors, love calling them back also. He told me they would come looking for me and I politely told him my gun holds 20 so bring an army. Then told the caller I have an International Carry Permit to carry anywhere I want and to look out his window, I am waiting to talk in person, he hung up quickly

    Same caller, Luke Gallows and call came from 888-888-8888 and to settle call 866-315-8234. They never told me what the debt was for just Luke Gallows from legal processing services and any recorders used previously will be used against me but again for what debt bc he never said. Also said they will execute this on 4/28. Is there a way to report people like this...this has to be illegal?!?!

    i have been receiving the same voicemail's for the last week. friday they told me i would be served on monday and i wasnt; started again stating i had until 4/28 or they would execute the claim. i called back the number and i spoke with a robert wolfe and chloe lennard - both which provided an email address and street address - i sent an email confirming the address because i couldn't locate them when i google'd it; and want proof of said debt.  they are claiming to be apart of a company called apogee portfolio in the account receivables dept - again no website. they have now somehow started calling my job and the same recorded message from luke gallows stating the message is for my "full name" i called them just now and received a generaic voicemail opening and have left a nasty messages about harassing me at work, and requested a phone call back from either of the two i had previously spoken with. if they do not call me back within a few hours i will call them again and again.

    The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

    is seeking payment on a debt for a loan you do not recognize;
    refuses to give you a mailing address or phone number;
    asks you for personal financial or sensitive information; or
    exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
    If you think that a caller may be a fake debt collector:
    Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
    If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

    Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
    Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
    Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

    Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
