- Sandra G.| 3 repliesI got two calls from this number twice on Sunday March 29th. Since I have Call Intercept, the phone rings like this: "Ring Ring----Ring Ring" and I KNOW that the person has their number blocked. They have to state their name or business name and then I have to press 1 to talk to them. If I do not want to talk to them I press 3 and they are denied access to me. When I called my answering machine the message was "Again, please call us back at 1-866-321-2195." Nothing else.
I am going to see if this is out of Orlando FL by doing a reverse number search. I posted several reports on this website about 407 numbers and those phone calls have stopped (about a car warrenty and reducing interest rates). - a concerned personThe calls are coming from Phillips and Cohen associates, Avery aggressive debt collector, only a suggestion, keep notes on the call, and know your FDCPA Rights before you speak to them for your own sake.....

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.
Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.
This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc. NCO Group is a debt collector that uses automated prerecorded collection calls. In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc. Mr. Watson filed suit under both the FDCPA and TCPA.
David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors. Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call. Judge Davis wrote;
[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.
Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.
So what can you do if you receive "wrong number" calls from debt collectors?
1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

We never call these numbers back because they generally ask for someone who does not live at this phone number and our new phone system automatically blocks phone numbers that come across the caller ID as unavailable, private caller or toll free. If this is a true debt collector that we owe money to they actually know how to get ahold of us since we have struggled and are now in automatic repayment plans. For any of these other so called collection agencies that keep calling for the other person that does not live here, we are glad for our new phone system. The phone will only ring once and the call is blocked.

- Wrong#I was getting this # a few months ago. I finaly talked to a person & told them they had the wrong # & they would ask if they knew anyone named XXX What part of wrong # do they not understand? They stoped calling for a bit & now they have started calling again!

- Sick And Tired!!I have been getting phone calls from this number (8663212195) as well. To the extend of 7-10 calls a day!!! I have spoken with several people explaining to them that I am not nor have I ever even known the person they are seeking. Every time they inform me that they will take me off their call list. Works for about a week or 2 then the calls start again.
I did notice the other day that my CVS discount card that I registered for, with MY phone number that I have had for the last 5 years, came up with a coupon under the name of this person they are looking for. I have contacted CVS and corrected the problem, but I am still receiving calls.
So, are companies like CVS and others that carry discount cards selling our info??? Or was this just a coincidence??- Caller: Phillips and Cohen Assoc.

- MMH replies to a concerned personThank you for this information...They are relentless...I never missed a payment on anything in my life and this number calls every day, several times a day...I am reporting them to the FTC for violating the FDCPA
- sandyfinally answered the call and said they were from phillips and cohen. that morning they called at 5:25AM . yes at 5:25AM in the morning. left their message for me to call them. i thought this was illegal? when i finally talked to them , i explained that i was just let go. i have no money coming in except for unemployment and they are threatening to freeze my bank account for the unemployment checks. they are calling now at least twice a day even after i spoke to them. i am about ready to call a lawyer.

If you aren't the person being called, and your name isn't being removed from their solicitation/phone call list: A good place to file a complaint is with the Federal Communications Commission. The rules they govern are stricter. I believe it is complaint # 1088
FCC doesn't mess with complaints; and my complaints in the past have usually been investigated!!!
FTC and donotcall, place complaints on a list, and will investigate, file charges if they see a pattern. So everyone needs to file complaints, so that there will be a definite pattern!.
Anyone have problems with Collection Agencies calling? There are laws to protect Consumers from these jerks. #1, they technically do not have any authority. They usually purchase charged off bills, from other creditors for pennies on the dollar. #2, because the bill is with an original creditor, and not the Collection Agency, you are NOT obligated to these jerks. They will try to convince you that you are. #3 the only way you become obligated to these agencies, is 1) if a new contract/agreement is done in writing, and you sign - but you are NOT obligated to; and 2) is if you make payment arrangements with them; thereby creating a contract/agreement, where none exist, when they first contact you!!!
The "Law of Novation" states that when a new owner of an account or an alleged debt, a New Contract must be written and signed by All parties, for a Contract/Agreement to be in place, with a different Creditor. Collection Agencies are known for violating Federal Consumer Protection Laws; and they are allowed to, because those uneducated in those laws, keep allowing them to.
If the American people, became educated in these Consumer Protection Laws, Collection Agencies would have to close their doors, due not not receiving any money, when customers are sent bills, or collection demand letters.
However, you technically do need to respond to them, if they are sent Certified mail, otherwise, they don't know, if you actually received them or not. A Cease or Desist or Cease Communication letter, similar to:

If you answer the phone, simply say:"I do not discuss financial matters by phone - send me a statement in writing and I will respond to it." Then Hang up!!! Otherwise, they will have you completely shaken!!! The longer they keep you on the line, the more chance they have, to get money from you including payment arrangements – or payment agreement/contract!!! You are NOT legally obligated to talk to them!!!
Collection agencies are ruthless jerks!!! They will tell you they are the original creditor when they are not - even though it is illegal, for them to do it, per Federal Consumer Protection Laws. You can legally sue them for $1,000.00 per violation.
When you do get a statement - google "FAIR DEBT COLLECTION PRACTICES ACT" One or more online Attorney websites will be shown. These websites will have valuable information, including a Cease & Desist sample letter; or a Cease Communication letter. Once received, it is a violation of the Federal Fair Debt Collection Practices Act, to contact you further.
You can also educate yourself by reading Consumer Protection Laws at www.ftc.gov; a lot of valuable information. Don’t have time, download and read later. You will be glad you did!!!
I am not an Attorney - just an Educated Consumer, in Consumer Protection Laws. I have spent hours studying these laws and becoming familiar with them. They have helped us and friends/family as well; and hopefully it will help someone, who reads this.
And for those self-righteous criticizers, who say, just pay your bills on time; things happen to people with Credit Card debt, medical bills etc., often beyond their control such as job loss, divorce, death, illness etc. and you find your self in a bind. We've been there, we know. You do not plan to pay late, or not make payments; but if the income quits - there's not a whole lot one can do! You then are forced to prioritize, Mortgage, Utilities, Car payment then food, if you can! Other things have to be let go!

Phillips & Cohen called me today and said they would not give me anymore than 20 hrs. to set up payment! Now that I know what to say to them, should I call back by Noon tomorrow (this is what she told me to do)and inform her she was wrong to tell me they didn't have to give me 30 days and did not tell me I could send a letter stating I wanted proof of the debt etc. and that I had 30 days to do so! Nor did she tell me they would send validation of the debt after receiving my letter and will also give me the address of Original Creditor if I requested it in writing. She just said I have 20 hrs. to find the money! I am disabled because of an accident and can't go back to work. It is however in my husbands name not mine.

- KBI received a call on my work phone, which on my caller ID as 215-391-1770. (that is a local call for me, in southeastern PA) I answer the phone thinking it was either going to be a business call or a doctor’s office, and I hear a recording saying “press 1 if you are <this person>. This is not a sales or marketing call”. The recording did not say it was from a debt collector. And yes, it is me, so I pressed 1. I then speak to a man asking me my name, and yes that is who I am. He said he is calling regarding a debt, and said his system would not let him pull up the information. I asked him what debt this is regarding, and he said he had no information. He then gave the 866-321-2195 phone number and a reference number. He did not even say “this is an attempt to collect a debt, and any information obtained will be used for that purpose”. He then transferred me to a woman and all I heard was “you are on a recorded line”. Then the call dropped. They did not call back since. I am not calling them back either. I looked at the company’s website and they do not even have a PA office yet the number on my caller ID came up as a PA number. Weird. Oh well, I am not calling these people back.

- Chaz| 1 replyMy neighbor received a call also. Upon returning the call to whom I thought was a Danielle, Danny / Danni, turns out might be a tranny and not at all a bright one at that. It is true that these people can contact your friends, family and even neighbors to get your contact information or whereabouts, but really, who would pay these people anything when they have used such tactics? Let them waste their time calling all over gods creation. The phone calls don't really bother me much and most of my friends and neighbors are in the same boat. Beware of calls from any calls from someone pretending to be a female going by the name Danni. You're not fooling anyone.

So I thought that I would have a little fun at messing around with him/her, not sure as I think it was someone pretending to be a female. Isn't that funny where you have people that can speak the language calling you when you don't want them to, yet when you need to talk with someone in another industry more often than not, you're talking with someone from India.

According to the Federal Credit Act 609
The credititor must have have the orginal documentation of the DEBT or they can not collected the DEBT.
This mean, they cannot use information from a general ledger. They need information with your signiture. If they tell you they have info from the FCC, that is a LIE.
This company is calling me but they have not sent me out a notice regarding the debt, which they must do first.

- Tired of this!This number 866-321-2195 has been calling my 84 year old mother OVER AND OVER AND OVER at all hours of the day looking for a person who has my maiden name (I got married 20+ years ago) and they are saying that this person lived at a different address than my mother lives and that I ever lived. They told her they were a collection agency. I have NEVER not paid a bill and have always paid on time. I have a great credit rating. My mother was smart enough to not give them my number but they keep insisting that she give me theirs so I can call them back. She has told them to please stop calling her. She is in a wheel chair and sometimes it is a major effort to get to the phone. She doesn't have caller ID. How can they get away with this? I'm praying they will go away!
