Me too..who are they. .they are constantly calling me asking for all this information from me. They are even threatening me. That if I don't call back they will use my name and social security number. Scammers!

Yes, it's the criminals from MSS & Associates....they never ask for anyone by name and I never answer and they always leave a message with some veiled threats about placing a freeze on your bank accounts, or sending someone to your place of business...or 'their is a file attached to your name and social security number" -- really ? You didn't say who you were calling, you idiot.
They called again on my cell phone this week from 866-332-6632.  They have also used about 5 other numbers ... they are in New York and call also from 716-328-0132. Call back number they usually use is 855-528-8454.  The same guy leaves a recorded message and has left 4 different names and has different bogus titles, like Director of Mediation, or Director of Documentation (very obviously the same guy in the recording and it lasts the exact same time each time, so they're using a robo caller). Has used the name Steven Bowmar, or Gilmar (static on the recording and you can hear people talking in the background), also uses Steven Flinn and Michael McCarthy as aliases. There is also a woman's recording with similar threats that says "Janet Jacobs", director of mediation.    I'm saving all of these, along with the date and time of each call, and where the call originated from, so that if I decide I've had enough and want to pursue in court under the FDCPA violations, this will be good info to have.  Also, Good News for Consumers -- just this week a court awarded a woman a MULTI MILLION DOLLAR JUDGEMENT against a similar scamming firm like this, so hopefully more of these will start to happen, and we will see these places shut down on their own, or be sued out of business. If there are any attorneys out there who have advice on how to go after these clown cars full of bozos who are irritating the heck out of people, please post here and let us know.... Thanks !

I have been receiving calls from Fraud investigation and also this number (866-332-6632) for the couple weeks. I never answer calls I don't know and always google numbers I don't know. They are definitely scammers. Fraud investigation; I have been receiving calls from them for the past 3-4 years and I am still waiting for them to sent the police to my house or even be sued in court I think they said in New Jersey, I live in Minnesota.  Once your name or phone number get on their list they will pass or sell it around their scam circle. It will never stop. I know they will keep calling and I will keep not answering. I do however continue to google the numbers when I am bored and have nothing better to do. That being said I guess I will go do yard work now.

I have been repeatedly receiving calls on my cell phone no. from a company known as MSS & Associates stating I need to return the call or a 1099C will be filed with the IRS for unpaid/cancel debt from a lender.  I made several attempts to call, left message first time did not receive a return call from a person so I could obtain some information and the second time, I stayed on the line for a considerable amount of time, thinking I would eventually be connecting to an actual person, then the phone disconnected.  Very annoying as I do not have any outstanding debt that would warranted this type of call!

Looks like this M.N.S group is  still  waving around IRS Form 1099C.  They are basically using the form as just another  threats in order to collect debts.

I've noticed that more and more of these fly-by-night debt collection groups are doing it.

An IRS 1099C is a report of a cancellation of debt  by a creditor in favor of a debtor/taxpayer.  The amount of the debt becomes gross income for the taxpayer.

The rules are complex for the entity forgiving the debt.  Only certain entities can issue a 1099C.

Unless the debt collector actually owns the debt and falls within the categories listed, they cannot issue a 1099C.

A 1099C is not attached to anyone's SSN.    No more so than any other form representing gross income to the taxpayer.  The form just lays out the amount that has been forgiven and must be included in the taxpayer's gross income.

I'm an Enrolled Agent with the IRS (inactive) and I can tell you that the person who called you most likely has no idea what a 1099C is and has (most likely) no authority to issue such a document.  They are  basically using the magic words "IRS" in order to scare people.

They are not filing anything, so far as I can see.  One of the reasons they won't file anything is that the creditor must also fill out the entity's  name, address and federal tax number on the form and they must file it with the IRS. And they must give a copy to the taxpayer.    This is something they are not going to do.  They want to keep their scammery-scummery business as secret as possible.

Ignore and block the calls. Do not return the calls.

No way are they going to file a 1099C for the reasons I stated in my post.

Just because a voice on the telephone claims you owe a debt does not mean you owe it
If a voice on the telephone claims you owe a debt:

1.    Demand the person give you his or her name, company name, and address
2.     Demand a debt validation letter by US mail.  E-mail no good.
3.    Do not pay  the collection agent or anyone else a  DIME  until the debt is validated.

Of course they won’t do this, no scammer ever will, so simply block their calls and ignore them.

If they continue to bother you, and you know you do not owe any money,  tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  You might have to yell at the scammer and talk over him or her.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them .
