To Whom it May Concern c/o Better Business Bureau-
This company has made repeated contacts to many individuals. They report they are law enforcement/ legal representatives in pursuit of issuing summons for court appearances. They attempt to obtain personal information from individuals which may be an attempt at phishing. When I have attempted to research the company, little material can be located. As they are representing themselves falsely and as they are clearly communicating with multiple people in an attempt to accomplish gain of an uncertain nature, I felt it best to communicate to you regarding these occurances. - AnnHarrassing my 93 year old mother about a supposed debt incurred by her grand daughter 4 years ago. Continually call and threaten to detain her grand daughter when she returns and then hang up on her. She had a supposed constable call and tell her they are waiting to arrest her grand daughter and then insulted her. Can the Better Business Bureau or state Consumer Protection agency do anything to stop these call? Her grand daughter lives overseas and only comes for one month a year. She doesn't live there.

- KatieI just received a phone call from this agency as well starting last evening at 5pm. Introduced himself as a private investgator. Told me I had 72 hours to appear in court with my lawyers and have an outstanding debt (which has been closed and is 6 years old) reduced. He attempted to get me to make an 8,000$ payment over the phone. Told me that this was a federal case and that it would follow me for 10 years. He told me that the sherriff would be sent to my residence and to my school if there was none compliance with the phone calls. Also attempted to make me believe that he could get my credit score up to an 830 (this number does not exist). Over all he was very rude and scared the holy crap out of me. His ext was 318 name Shawn McElvain (not sure about spelling)

- caller01I got a call from a Mr McMann. Did not know my correct name. But he also threatened me by saying if I did not call him back or have my attorney call him back withing 15 minutes he would have to make a decision regarding my case. I don't even know what he is talking about. All I can think of is that he is from a collection agency. However, it is not legal to call and harrass a person's family or call at their place of employment and threaten them with legal action. He also had called my brother and father trying to reach me...they gave in to him and gave him my number. I looked up the docket and case number he sited and it does not exist.
The next day I got a call from a woman...basically leaving the same information...but this time said they were representing their client. So..same story as before, on they used a different tact.- Caller: bryant lafayette and associates

i talked to this "attorneys office"...collection agency...they actually cleared a bill for me that was 5400 for 2600...i am happy because i was trying to get this thing taken care of for awhile now. I dont know about you guys but they were very professional with me and sent me my letter and i talk to bank of america and they sd it was all legit and the account is now closed. i dealt with mr.mcmann at ext#315....if u do have a problem and these guys call u i would say call mr.mcmann...he helped me and maybe he can help you too...- Call type: Debt collector

they called me and i looked on this site had a payment setup up for 6500 because i wanted to clear my credit saw they were a fraud and stopped payment because i thought they were a fraud. then they actually filed paperwork so now im looking for an attorney to represent me on a 18,ooo case and the cheapest one wants 1600 as a retainer and is telling me maybe he can get it reduced to half??? - DeeI received a call from 1-866-359-0770 and the person's name was Investigator Ed Martinelli ext 312. He left a message stating I or my attorney has 72 hours to return his call because there were 2 complaints against me and it was a matter of federal and state law. He also stated that they had been sending me legal notices and that I am clearly ignoring them and a summons for me to appear in court was to be issued. I called back right after hearing that message, not to mention my first name was pronounced wrong. I called with the case number he left on my machine but when he picked up he did not ask me for it and then stated the information is not for me it is for a relative and the reason he called me was because it has my social security number but her name and birth date and that I am partially responsible for the 5,000.00 debt. I explained to him that this debt he is talking about was removed from my responsibility by Bank of America years ago and that I had written proof. He ignored my statement and said I will need to appear in court and explain it to the judge. He states he can have mt portion of the debt settled for half and pursue my relative for the rest. Why can't they pursue her for all of it since I am not he one who did it and I asked if I needed to contact Bank of America and he stated no because the debt had been sold to them. I asked him if I were to pay I need what he is telling me in writing and that I would need to break up the payments. He stated he would call me back and even wanted me to think about paying the debt and call him back the following day. That makes no sense if you plan on filing a summons within 72 hours. He stated he could send the information by mail but the corporate office is in NY and that would take too long. He offered to send the letter I wanted via e-mail but by the end of the call he never asked for it. He also asked if I know what happens if a person is to appear in court but does not show. I said no and he said a bench warrant for that person's arrest is issued. Ok that may depend by state but in the state of Florida bench warrants are not issued for arrest because you failed to appear in court for not paying a bill. He states they look at it as an attempt to defraud a credit card company. That may be true but I did not open the account and again had all of this squared away with Bank of America by actually talking to them. The bottom line ... he never called back yesterday and I would love for them to have me appear in court because I have in writing from the actual company I am not responsible for the debt since I sent them proof I did not do it and they did a full investigation. I may be the one coming out of this with money not the other way around. He even had the nerve to suggest me do harm to this relative for doing this which by far is beyond un professional. This is not the first time I would have to go to court for a relative opening and account in my name. I have done this before and as long as you send an answer to the court with proof anyone including myself will get the case dismissed.

- LoraId the same thing about the check...my attorney told me to stop payment on it, and now this firm threatening me with a Federal offense. Something told me this didn't feel right after the fact. Will look for an attorney after the holiday. No one is open today. Friday for the holiday. I will counter them with a harrassment law suit if they proceed with these collection tactics. Not to mention they posed as investigaters and couldn't even say my name right.
