    They stated that I owed money to a pay day advance company but could not give me the exact company that I was suppose to owe. Stated this debt was from 2010 yet I have never heard from any company saying I owed any funds. Seems the statue of limitation would be up by now if I had indeed owed any money. Definitely a scam.

    The statute of limitations varies by state from 3 to 10 years for most types of debt. In addition, it only prevents using the courts to force payment and except for a tiny number of states does not prevent attempts to collect old debts.

    Cardinal is well known around here as a criminal enterprise.  The statute of limitations (not statue) simply dictates how long they have to sue you, not how long a debt can be collected.  Regardless the DC must abide by Federal and State laws.


    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  


    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    Recieved 5 calls in a matter of 4 minutes saying i owe a payday loan. I never had a payday loan. If i cant pay cash i dont need it.

    Complete scam. They claim to have tried to deliver documents, total bull. When a debt collector cannot give you the name of the original creditor, who the account was sold to, ect...this is a BIG red flag it's a scam.
