They never called me but filed a law suit with the court. They are seeking payment of $9,400.00 for a credit card debt that was closed and the amount owed is $2,200.00. We were making payments to Capitol one. They bought the paper for .30 cents on the dollar and is seeking $7200.00 in what they call fees and intrest. Never recieved anything from them or Capitol one, just a citation that I am being sued. Scum, both Capitol one and these [***].

Be careful with this debt collection law firm. I successfully defended a SOL issue against them, but while I was waiting, I saw them receive summary judgments against 20 individuals plus 5% post judgment interest for debts ranging from $532 to $17,500. They will sue without hesitation, it seems. I was able to prove that the statute of limitations negated their ability to sue me for 6 yr old debt that I had ALREADY paid with the original company in settlement. It didn't matter that they did not ever send a process server to me. Luckily, what did matter was that when I got the notice of trial in the mail, I was able to quickly get a copy of the complaint. All debt collection lawsuits are for breach of contract. Also, in Texas, they are not required to supply you with any documents until the day of trial since it is a civil issue. This law firm is aggressive and extremely difficult to work with. I ended up doing a ton of research and defending myself since I couldn't afford the $3500 retainers the consumer law firm needed to take my case.

They will get their summary judgment unless you show up with evidence. I ran into the same issue with a Capitol One credit card account. I watched 5 more Cap One accounts go the way of this law firm. You absolutely MUST get in touch with Cap One for documents to prove your side. Also, make sure the debt is not over 4 yrs old. If so, the statute of limitations has expired unless you contacted them (law firm) prior to the statute running out(if you live in TX). Once you speak with them, it starts over.

And I agree with you regarding Capitol One. They sell debt that is up to 10 yrs old, so it doesn't even show up on a credit report. Additionally, you have to look at the laws for SOL in your state (mine's TX).
Be assured they will show up for the court date. Good luck!

Until I did some research, I fell for their lies. I got sued for a Capitol One account that was not even mine. I went to court and everything, but they depend on the fact that people cannot afford the $3500 retainer for a consumer law attorney and the judges do nothing. So now there is a judgment against me saying I have to pay some $7000 to them. They get a money order for $1/month. Screw them. I'm educated now and will fight any bogus debt collectors. Check your state's statute of limitations on consumer debt as well. They completely ignore this and if you don't provide documents from the original creditor stating the date of last activity, they can get you because you can't prove otherwise.

I started receiving calls from this place last week.  It's a computer generated voice, asking about my NEIGHBOR!!  I just hang up on them.  I used to give live phone calls from these kinds of places, asking about my neighbor and they were incredibly rude and vulgar.  I will be filing a complaint with the FTC.  Isn't it illegal for them to harass people?  I'm not even involved in whatever is going on with my neighbor!!

You are wrong... There are basic discovery rules in civil court and they DO have to supply documents IF you ask for them. Do it early on and get it thrown out when they cant supply proof of any debt with them.

Search how to do it and most importantly, what to ask for.
