    If the debt is properly discharged in bankruptcy, no they cannot collect on it.  If the debt is written off by the creditor, the original creditor can still sell the written-off debt to a debt collector and that debt collector can attempt to collect on the debt.  Unfortunately that is when the debt scamming starts.

    Just because someone on the phone calling you says you owe a debt does not mean you actually owe it.

    If a voice on the telephone claims you owe a debt:

    1.    Demand the person give you his or her name, company name, and address
    2.     Demand a debt validation letter by US mail.  E-mail no good.
    3.    Do not pay  the collection agent or anyone else a  dime until the debt is validated

    Of course they won’t do this, no scammer ever will, so simply ignore them and block their calls.

    If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

    You'll probably have to yell at them and talk over them.  Tell 'em  no scammy debt collector is going to push you around.

    You have to get tuff with these people because,  being akin to thugs, brute force is (metaphorically speaking).   the only thing they understand.

    These people will not stop calling me!  They call everyday, several times a day!  I quit answering after I pretty much got an attitude with them in the middle of a store on CHRISTMAS EVE while I was Christmas shopping!  They just don't stop but they really need too!

    Enough is Enough
    This number has been calling on a regular basis, appox 4 to 5 a week for the last month. Reading these posts it appears folks think it's debt collectors but since I haven't borrowed on credit for 10 - 15 years and owe no one. Sounds like a scam to find working numbers. They are blocked and I don't answer. Do you think this will ever stop? Don't think so without the dominating Washington deciding to give us a break and requiring phone companies to supply the already available technology to block to the customers for free.

    BH, you're replying to a post that's 3 years old but YES, BIG YES...call blockers work.  There are many brands with various features for both land lines and cellulars.  800 notes has several forums that discuss call blockers.  Just put "call blockers" into the search box and you'll bring up the links.  I have only one piece of advice with respect to land line blockers.  Get rid of your service providers voice mail and use a phone with a built in answering machine.  That way, when you block a call, it can't get to your voice mail either.  You can also get phones that have built in call blocking.  Good luck. :-)

    They left a message for me two days ago, re a collection.  I don't owe anyone anything....so I called them and it is about a "bill" from 2008 from Charter for an address I never lived at! Went through this same hassle two years ago and all three credit reporting agencies kicked it out of their records because it's not mine! Now, here we go again and it's so annoying!!!

    Number calls several times a day.
    I do NOT answer numbers I do not recognize.  ADVICE GIVEN BY FBI.  They say the scammers operating out of Africa are now in Pakistan and they can hijack American business numbers that using any of the 1 8--  numbers and you have DSL internet, once you answer they can actually drop a virus, malware, etc, into your computer through that line: then you start getting messages on your computer "like "this is Microsoft call us immediately or your computer will crash", for example, also resending all your Facebook friend requests and then actually having online conversations pretending to be you and convincing your family and friends to join some great prize,  don't be a sucker!
    In addition, look the number up immediately and if it shows as a scam line, then put it on your call blocked list.  With landlines this is usually a service you have to get and the limit of blocked numbers it allows is only 10.  So be sure to check into your own information for your particular situation.
    This number seems to be a scammer number.
    Also do not call unknown numbers back, they can still drop the virus, malware.. on you when you call them.  Let the curiosity go!  Killed the cat!  Will kill your computer, id, credit, etc...

    If they have left a message or talked to you this is what they must now do:

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt.  It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    If they haven't then they have violated federal law.  But in any case:

    You need to send them a certified, return receipt debt validation or cease and desist calling letter (think of it as the best $6.47 you ever invested).  Also send it first class mail in case no one will sign for it.  Make a notion of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/

    I feel sooooo much better
    I have been getting calls from allied intersta for months under numerous different numbers. Just for kicks I decided to answere. They were looking for my ex husband of more than 9years. I had left him in 03 after he tried to kill me and moved for states away. So when this foreign voice asked for him I lost it.  I demanded to know WHY he would think that this number was for him. The "poor" kid flustered and said its the last number we have for him. I called him a liar as my ex has NEVER lived in this state. The kid said I will remove this number. I told him he better leave it on there with a note to never call this number again. I tend to get a little emotional when when my house is violated by callers looking for an abusive ex. Believe me I always know where he is. It's a survival technique. It did feel awfully good to yell at someone elses debt collector. Bad thing is every time I think I've finally crawled out from the debt he put us in, something else comes up. At least this one just wanted idiot. I wish I could say this was the first time someone has called looking for him. They all get the same ptsd response. Most are very apologetic and never call again. Must not like to talk to a crazy lady with ptsd!
