- Aggie| 2 repliesFake payday loan collection call threatening to take you to court for breech of contract. Received several like this from different numbers recently. Said file went back to 2009! I'm assuming that's so you have no way of proving you paid it if the debt was actually valid. They all have the same script and same threats like wire fraud, conspiracy etc. Be careful...I think it's all the same company and once you play into it, they will keep going after you under different company names. They all have the same type of accent also. VERY SUSPICIOUS!

There's only one way for debt collectors to prove this;
All debt collectors are required by law to send you a DEBT VALIDATION. This is sent through the USPS ONLY (email, text, faxes, carrier pigeons, smoke signals...none of those count) and state when you incurred the debt, to whom you owe the original debt, and how to proceed should you not recognize the amount.
This must be sent within 5 days of the first time the company attempts to contact you.
REAL DEBT COLLECTORS SEND THIS. Scammers do not.
A few other things to know-
-You cannot be arrested for ordinary debt in the United States.
-Process servers do not call in advance. They only get paid if they deliver you papers the court (not a private company) has ordered be delivered, and if you flee, they don't get paid. Therefore, they do not call ahead of their arrival.
-Likewise, officers do not call you to tell you they will be arresting you. Why would they?

- JackieI spoke with Jose at MCO arbitration finanacial company called called on behalf of Fox Enterprises (which I've never taken out a loan with) to say I owe roughly $360 for a loan and if I don't make a payment today (either in full or a payment plan), they will serve me court papers.
MCO called me and said I took out a loan for about $360 in 2010, that was deposited to my bank. They named my bank and knew other private information. They threatened to serve me with papers and I would have to go to court and have to pay 3x as much if I did not make a payment today. The rep said I'd have to pay judge fees and other costs. I asked for the name of the company and address and was told MCO doesn't have an address. I then asked you're a company and don't have an address? The guy responded yes. I also asked for whatever documents MCO has that states I owe these monies they can send to me via mail. Jose then stated well you've been informed so good luck in court and I hung up the phone. I guess Jose is out of luck since this is what is required by law:
"Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

- MidNYteStormDebt collectors have a proven history of calling outdated numbers and harassing innocent third parties. I know this is a fact because it happened to me.
- RichI too was contacted stating that they had a collection from a payday loan from back in 2012. I informed them that I have never used a payday loan and that if they would like to have any payment, they need to send it via the mail. The girl on the phone said they don't mail things, only email. To which I quickly replied, that's cause if it is in the mail, it then becomes mail fraud as well. I am not paying anything until you mail it to me so my lawyers can review it. She hung up on me.

- Iris RobertsThey called threatening to take me to court so that all the payday loan that goes back to 2009 they couldn't prove or disprove that I had it that they were calling on behalf of another company they made it so threatening that they were taking me to court I was very suspicious but at the same time I gave into a retainer fee of $100 which I'm going to have my bank try to recoup that back and what made me suspicious is that I do Online Banking & I noticed that the charge came from Mexico and saw that immediately set up alarm bells I think I'm going to get our state attorney general involved in this

- annoyed!| 2 repliesSCAM!! they've been calling me OFF the hook, they called my Dad, my dad's work, my work, my brother and sister... NO IDEA how they got any of our phone numbers!!! When I call back and confront them that I've never taken out a loan before they just hang up! Finally I spoke to the "manager" after I called them 15 times with them hanging up on me every time..... he hung up on me 2 times before I could even say anything.... the third time he said please stop calling us (what kind of "debt collector" says please stop calling us?) and I said YOU STOP CALLING ME and I wouldn't keep calling if you guys would STOP hanging up on me!
Also... apparently everyone in that companies name is "Bernice"........ different women talking... all named Bernice... the guys names are all Kevin also, same accent across the board.... it's like a house of PATHETIC worthless people scamming people who do not know any better. DO NOT FALL IN THIER TRAP!!!!!!!!!!!! IT IS NOT LEGIT!!!!!!!!..... HOW DO you stop this!!!?!?! it's embarrassing that people I know are getting called and also that im getting called at work! I don't even have any loans, nor have I ever taken one!
This happens almost once every year to me too..... one time some ghetto hood rat girl NAMED BERNICE (weird) was saying the same [***]... after I told her that I don't have, nor have I ever had any loans, and to stop calling she threatened me that something would happen with my SSN, that I'd end up going to court.... that I'd go to jail for fraudulent checks???, it was something different every time. all they do is call and try to scare the crap out of you. And I know that this is a scam, because I did not receive mail or email about it, and I had people try to pull this scam on me before. So I know for a fact that I did not borrow money from a company, and I did not breach a contract. No debt was properly validated.
- Joshua TerryThis number needs to be reported. They tried calling to me to say that I owe $480 to a payday loan company called Liberty Group, LLC. I did not borrow anything from this company, and these people tried to tell me that I borrowed money and I breached a contract. I have not done such a thing. And they didn't validate the debt to a creditor either. So this is obviously a scam.

I have different scammers calling all the time. Just pick up the phone then I hang right up on them. These ppl do not scare me smh
- AnnoyedI have been receiving calls from this same number for about a month now. They say they are calling for a payday loan I took out in 2010 from JD Marketing. The first time the loan was $500 now it's $300. They had the last 4 of my social and the last 4 of a closed bank account. I have asked for a fax number and mailing address to give to my attorney and they won't give me that information. They are very rude and argumentative. Tonight when I asked for proof of the loan they said they made mailed multiple letters, I asked for return receipts for proof and the jerk said I would get all that when I was served. When you let them know you know your rights, they get very mad. They were calling from other numbers before but mainly using this number now. Please anyone that gets these calls, look up the numbers online and look up company information as well. I will be contacting the attorney generals office in my state tomorrow.
