- Michael| 3 repliesI have seen a number of threads about Lincoln capital corporation, and this is the number they provided to me. I was called by Commerce Investment Group about an old Bank of America checking account, and given the number for Lincoln Capital to resolve an outstanding debt. I spoke with Michael Stone, (another name that keeps popping up) and he told me that they would be serving me papers and taking me to court, where i would be charged $1,900 in legal fees and outstanding balance charges unless i made arrangements to settle the debt of $889. I have spoken with a TransUnion representative, and they have no record of either company owning my debt. Michael Stone gave me the same address, 1105 S Euclid St. suite D 162 Fullerton, Ca 92832, that other people have mentioned.

- BigA replies to Michael| 2 repliesThat address is a UPS store. They have a mailbox there. They could be located anywhere as UPS will forward the mail. They must follow the law and so far they have not.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

If they tried to mail me something but sent it to a different address and so I never received it, does that still count? I had originally given them my debit card number and signed a form to set up two payments to resolve the debt, but after reading all this i had that card cancelled just in case.
- BigA replies to MichaelIf you never received it no, and I am sure they will tell you that they mailed it out a lot of times. That company name is a known debt scammer. Using a UPS store is common among debt scammers. They are required to follow the law, end of story.
