- Stopher| 1 replyA woman identifying herself as Karina Lopez (did not provide any name of a business or government agency) left me a voicemail stating that she is calling regarding a Civil Complaint that was scheduled to be filed out of XXXXX County (the county in which I reside) where there will be "an attempt to file legal documents on this complaint to the residence located on XXXX (my street address)".
She added that, if I will not be available to receive and sign for several documents or am unaware of this pending matter, I can contact their office (again, no business name) at 866-558-0193 and reference an ID number they provided.
She concluded by saying that, if I do not call within 24 hours, they will be forced to make a legal decision on my behalf without my consent.- Caller: Karina Lopez

I called the 866-558-0193 number back and someone answered and said, "Hello?" I responded, "Hello?" and they hung up.
I called back immediately and, this time, someone answered the phone in a similar voice (but I could not confirm if it was the same voice), "Davis Law Firm". I advised I was returning a call and I was transferred "upstairs".
After a minute or two, a man identifying himself as Daniel Sanchez answered. I provided the Reference ID they gave on the voicemail and Daniel confirmed my date of birth and the last four of my social security number (which I did not provide).
Daniel stated that I was part of a civil complaint for breach of contract with Providian Bank. He stated they sent me a letter back in March 2022 (which I never received) and that they attempted to serve me on Sept. 7th - for which I was home all day as I work 100% remotely (as I am most every day).
I asked when the complaint was originally filed. Daniel said 2008 (the state I live in has a statute of limitations for debt collection of 6 years - 4 years if it is an auto-loan).
Daniel said:
- My total debt was $5,820.81.
- If it goes to court, it'd be $11,236.36 (with added court costs).
- They'd agree to a 50% settlement today for $2,910 to be paid in full or
- To be paid in 24 monthly installments of $242.50.
Daniel then did threaten property liens, wage garnishments, etc. if it went to court.
I then told Daniel that I had no recollection of this account/debt from anywhere in my past, that no documentation or evidence had been provided to me, and that I question the validity of this debt in its entirety until proof can be provided.
I said that I would not simply pay someone thousands of dollars over the phone without any sort of legitimate documentation or evidence.
Daniel then began citing my entire social security number and naming other credit lines and credit accounts that I currently have open in an effort for him to seem legitimate - FOR ME, THIS IS A MAJOR RED FLAG THIS IS A SCAM.
When I questioned why he would have access to my full social security number and tell it to me over the phone (which is an information security breach for any legitimate organization), he doubled down on the threats of being served, property liens and wage garnishments, and paying the full amount when the judge orders it. He added that he recommended I get a lawyer.
I told him to remove my phone number from their call lists and invited them to provide me the documentation as proof, and that I would avail myself of the legal system should this be a legitimate debt.- Caller: Davis Law Firm
