    Scam I have blocked them and they send me spam text messages from different numbers saying I have a overdue bill and need to take care of it today I answer a call thinking it was return call from my insurance company. Nope it was this scammer saying I had over due bill with capital one never had any account with capital was told I was being sued by capital one and they were the lawyers representing them. I asked them to send documentation via email or mail. She told me she would that was Months ago it was suppose be certified mail called capital one and was ensured by supervisor that I never had an account and they would not sue for $1,000 thank God I didn't give them any information somehow they keep sending me messages like today from random numbers lol

    They said they are called associates recovery group they had my full birthdate and Social Security number. They’re telling me that that I’m being sued for allegations of breach of contract and defrauding a federal bank for a debt. I’ve never even heard of with Citibank. The girl was willing to give me her full name, but could not give me any information except the last three digits of an account number I’ve never heard of and all she wanted to do was threatened that they would be taking me to court.

    The fake process server/location specialist scam usually contains:

    They mention that they have received a Fax document or that some sort of complaint has “come across my desk” and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.  

    Federal law (FDCPA) requires them to send you a letter, email, or text (postmarked in the case of a letter) within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. Unless they have communicated it to you verbally at the beginning of your conversation. It also must contain the “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this communication must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that communication you should immediately send that debt validation letter by certified, return receipt mail.

    First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

    Technically, they are only "lent" to the person for a short period of time, and while they are most likely shiny, it would be doubtful that they are "new" (and probably not unused for that matter).

    They listed a legal name I haven't used for over 13 years and gave me a date when I never went to the hospital.  They had my birthdate, correct name, new address and my correct social number.  Scary.  The woman was rude and said I owed over $2,000.  I could pay her now or go to court.  She also threatened they would garnish my wages but she only knew the shortened form of my old employer.  I told her I needed something in writing.  She said that she would start the legal process and my credit would be ruined.  Then said "Good Luck!" and slammed down the phone.  What a horrible scam.  So many people would pay this.

    Received multiple calls stating that I had a past due balance of $897.33 from Tennova Hospital.  She said the Dr was a Dr. Brian Cooper and the date of service was in May 2016.  They had my name, the name of my insurance and several address that I lived at.  Claimed that if I did not pay today then they would be forced to take legal action and they would seize all the bank accounts associated with my Social Security Number.  If I did not pay then the amount they would seize is $4K.   I advised that I have NEVER received a bill from them, they said they are the mitigation dept and they have sent several notices.   I asked for them to email me the bill.  She stated they can email an agreement while I am on the phone and once I sign the agreement they would send the bill and it would stop further collections.   I then asked her if she would pay for a bill from a phone call that she has NEVER seen.
    After the call was disconnected, I called Tennova Hospital who confirmed that I DO NOT have a past due balance and there is NOTHING IN COLLECTIONS. !
