- EddieGot called by scammer 01-10-2019 15:13:41 EST, person stated they worked for Ellis and Associates (Phone 1-866-629-0921). Gave me a case number and said they would be filling a Civil Complaint against me for money owed to Radio Shack from 2005 in the amount of $1,675.17. I have never bought anything for Radio Shack with that kind of price tag, so I knew this wasn't right. I believe they are phishing for an opportunity to commit identity theft or some other sinister deed.

As well as:
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1
Also file a complaint with your State Attorney General's office.

If you feel your SSN has been compromised, in addition to putting a fraud alert at the 3 credit bureaus, you may want to notify the IRS. Here is the link, fill out the proper form (probably 14039):

- B-Edwards replies to FranCalls indicate this is a debt collection scam. Knowing that your "info" is in the hands of a crook is one of the ways these scammers use fear to get you to pay a debt you do not owe.
I would not freak out beyond the usual level if they have you social. If you are worried, you can set alerts with the credit rating companies and maybe you bank. With all the data breeches, most of us have social's that are in the wild. That info is for sale. Privacy is relative, you can only do so much. - jjjjjjjjjjcivil suit pay half now it's will go away is this real have a case number
