    Call is for Madeline Moreno. Caller is Steven Bitterman, self described as an independent process server. Called 06/27/18, at 4:21 pm. Caller ID said "Private" number. Caller said he would process serve her between 3-5 pm on 6/28/18. Either it was a wrong number, a scam, or someone just Phishing.I was going to give a courtesy callback, but thought better of it, so here I am.

    No one showed. It's a scam. Real process servers, independent or otherwise, don't call in advance because then you could simply avoid them. They also don't give you the option to pay your way out of being served which is what these scammers will tell you if you actually speak to them. Block and ignore such calls.

    Extortion scam.

    They will mention that they have received a Fax document or some sort of complaint and that there is a pending legal matter or action about to filed against you to create the sense of urgency.  They tell you that they are a “process server” and cannot give you the particulars of the case since the file is sealed. This is simply ruse to get you to call another number (often with a made-up case number) where they will ask for money to “make it go away” (this is actually the same place, they work in teams, one pretending to be the server, and the other usually pretends to be a lawyer).  They threaten to serve you at home or at work.  They tell you that if they serve you at work they need a supervisor, security, or HR person there as a witness, hoping that will cause you to panic over the alleged embarrassment of being served at work.  They also tell you that you will need two forms of ID.  None of which is true.  Process servers do not ever call ahead so that you can dodge them.  Process servers get paid to serve papers, nothing else.  They certainly are not going to pass up a paycheck by telling you that you can avoid being served, they are not going to give you an extra day or even a few hours to get a “stop order”.  Court documents are time sensitive and have to be served within a certain amount of time.  Remember that you can always call the local courthouse to see if there is actually a lawsuit that has been filed against you.

    It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid. 

    Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

    This # left a voicemail on my child's phone asking for a Dominick Mayhue yesterday. (My sons name is Dominick and our last name does start with M but isn't Mayhue) They say they are affiliated with Douglas County which is not the county we reside in. Today they called and he answered. They asked if he received the message yesterday and when he said yes they reminded him that they would be out tomorrow around 3-5. I called back to tell them they were harassing a minor. The guy was a total jerk, continued to interupt me, and told me he was assuring me they called the wrong number if I would just listen. He then hung up on me. I called back, said I wanted a supervisor on the line, he laughed at me, put me on hold for 30 seconds and then hung up. When I called back from a different phone the same person answers. This is a scam of some sort.

    Got a call and voicemail similar to what is mentioned on the posts above. I argued that my account (with wells fargo) had been paid in full. They only asked a few basic questions about the letter and said they would not serve me because I had proof of the account being paid. I, obviously thinking this was a valid call  questioned why they weren't asking me for a copy of it or important information on it. The lady said she believed me and didn't need to see the letter. On top of all this the addresses they had on file for me were very old. I never let the conversation get into the details of how this could be handled but they did mentioned that my balance had doubled over the years and I could be sued for 3x's the amount. I called wells fargo to validate the call and they confirmed it was a scam call.

    I called the number and spoke with a man who said he was working for a mediation company. When I questioned what this was about he stated I had a balance due with Wells Fargo from 2009.  I explained that I had not ever had an account with Wells Fargo until last year. After going back and forth I told him I would call the source and ask Wells Fargo.  He was very cocky and told me to go ahead. After speaking with Wells Fargo (3 different departments) they reassured me that this was a scam.  I called back the "Mediating Firm" and spoke to the same man now just to mess with him.  I told him per WF there is no account so please don't call me anymore.  He insisted there was an account.  That's when I told him please have me served so my lawyer can handle this.  After that all I had was dial tone. Go Figure!
