- Alfalfa replies to ClaytonThe Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
•is seeking payment on a debt for a loan you do not recognize;
•refuses to give you a mailing address or phone number;
•asks you for personal financial or sensitive information; or
•exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
•Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
•Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
•Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
•Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

- 1huntrCalled my ex wife and said I had 1 chance to call them. This has happened to me before. I paid almost 1,000 to a company to find out it was a scam. Don't know if this is the same company but they use the same scare tactics .
- Bug replies to Anonym### "they could come and confront me."
That's very revealing! These fools think that 'being served' legal papers is a "confrontation!". It is NOT!
The deputy sheriff, usually an old semiretired person, appears and gives you some stapled papers. He asks you how your family is doing, and you ask him how his garden is doing, then y'all say goodbye and he drives away. It's no big deal whether it's at work or at home! It's certainly not a confrontation - that would be unprofessional! - Michelle ObregonThey have called my mother, step-dad, and ex-husband. I NEVER give out my step-dads or ex-husbands information. They are going off of credit reports to get the information. AND, if they are doing that, they would see that there is a fraud investigation going on, and they would have all of my updated information. They just called today and said they needed to get ahold of me to serve me a subpoena. I don't know what is going on, but they are really irritating my family.

- Jennifer| 1 replyI JUST got 4 calls from 1-866-796-7202 in a span of 23 minutes, 1 left a VM. 1 hour prior, I received a call from 777-777-7777 with no VM. The message was from a "Steven Nelson", who has a thick accent (don't they all?). The message is that this is my 1 and only chance to contact them and a case number. I need to supply my home and work addresses so they can serve me papers on charges of fraud and blah blah blah. Excuse YOU?? First, your inept VM says "Jennifer"..no last name provided and if you were an actual process server/legal firm, you would already have that info, correct? Why would any intelligent person call YOU and volunteer personal information? Perhaps you should read up on the laws of debt collecting and harassment. I'm not cold-calling you, forget it. When googling your contact info, shouldn't a reputable firm be found? It was only this spam info....Interesting.

- Tom - KansasReceived a call from this guy calling himself Frank Douglas. He asked for Frankie (my wife) and since this was my home office phone, I asked what this was referring to. He immediately got belligerent and said get Frankie on the line now or he would charge me in obstruction of justice. I asked again what this is in regards to and he yells out Just get him on the line. Put Frankie on the phone, I need to speak to him. Keep in mind, Frankie is not a guy, this is my wife. I hung up. He called back 3 times and I refused to answer the anonymous/blocked call. Then I noticed he left a message. This idiot then stated he was working for a firm and he is requiring the address of Cecilia __________. There were charges being filed against you Cecelia and you have one opportunity to get this resolved. You are her by officially served. So this changed from charges being filed on my wife Frankie to now the name is Cecilia?? They must have one hell of a list of people they are calling to scam you out of your money.

- JENNIFER replies to JenniferI have received the same message from Steven Nelson with a case# stating that I must contact 866-796-7202 before he comes to serve me with legal papers. Steven left voice mail stating that I have already been given a chance to contact the above number and didn't not do so. That is not the case, I contacted the 866-796-7202 phone # as soon as I received a message from my boss (telling me someone called to tell me I must contact them or will be served in 45 minutes yesterday afternoon). When contacting this number all they would tell me was I owed someone 753.00 and refused to send me proof of the money that was owed. I ask for someone would could give me proof and was advised it didn't make sense to email me proof when I would be served and once I was served nothing could be done on this other than I would have to go to court. I then advised this person that if they didn't send me proof of this debt and who it was from legally when they took me to court they judge would throw it out because I never received anything advising me of this debt and proof of this debt before I was served and that since they refused to send me this info I wasn't giving them my info. Person stated we could settle out of court today. When I refused to settle this debt without proof I was advised to have 2 proofs of ID ready because I would be served and she wished me the best of luck and hung up on me. Real debt collectors wont hang up on you and get nasty with you when you advise them of the laws you know. BEWARE OF THESE PEOPLE!!!
