A woman identifying herself as Emily called and I hung up not recognizing the name/number.  She phoned back multiple times, and when I didn't answer, she left this message for me:  "BIG FAT LOSER!"
I called the number back, asked what company she is with.  She said Gen Tran, and refused to disclose the reason for her call, and also denied leaving the message.  I saved the message, advised her my next call is to the Attorney General's office, and demanded she immediately cease and desist with the calls and unprofessional conduct unless she can adequately identify the nature of her business.  Frankly, even if this is a legitimate issue or debt, "Emily" has already completely negated any further dealings due to her offensive behavior.

i just received a phone call from a Kristen Wagner who sounded EXACTLY like a Emily Virgos that called me the day before telling me I have a litigation filed against me.  Funny how these 2 women sound exactly the same and said the exact same thing.  They both have threatened to get my pay information and bank info.  These people really need to get a real job and stop harassing people.

    Report them:

http://www.consumer.ftc.gov/articles/0149-debt-collection (Threatening civil proceedings with no intent to follow through, or threatening criminal process in order to collect a civil debt is a  violation of the Federal Fair Debt Collection Practices Act.)  The same goes for endless telephone harassment

If they continue to bother you,  and you know you do not owe any money, tell them that you know this is  a debt scam and that you are making a complaint to the police for extortion.  Once you get a copy of the police report and they call you again , just read out the  file number and the name of the PD or Sheriff’s office involved.   Tell them you’ll be glad to send a copy to them at whatever address the jack***es are working out of now.

An absurd threat.  If they are willing to forgive the debt, what makes them think a debtor would be willing to negotiate anything.  Total nonsense and a scare tactic.

Total scam.  An IRS 1099C is a report of a cancellation of debt  by a creditor in favor of a debtor/taxpayer.  The amount of the debt becomes gross income for the taxpayer.

    See:  http://www.irs.gov/uac/Form-1099-C,-Cancellation-of-Debt

The rules are complex for the entity forgiving the debt.  Only certain entities can issue a 1099C.

    See:   http://www.irs.gov/pub/irs-pdf/i1099ac.pdf

Unless the debt collector actually owns the debt and falls within the categories listed, they cannot issue a 1099C.

It is unlikely that the person calling you has any authority to issue a 1099C.    What is happening is that more and more of these fly-by-night debt collection companies are calling people up and waving around IRS 1099C forms  in order to frighten people into paying them something.

A 1099C is not attached to anyone's SSN.  A 1099C is not connected to anyone's bank accounts.  No more so than any other form representing gross income to the taxpayer.  The form just lays out the amount that has been forgiven and must be included in the taxpayer's gross income.

I'm an Enrolled Agent with the IRS (inactive) and I can tell you that the person who called you most likely has no idea what a 1099C is and has no authority to issue such a document.  They are  basically using the magic words "IRS" in order to scare you.

They are not filing anything, so far as I can see.  One of the reasons they won't file anything is that the creditor must also fill out the name, address and federal tax number on the form and they must file it with the IRS.  This is something they are not going to do.  As much as possible, they want to keep their physical location and other information secret.

    Look at the form:  http://www.irs.gov/pub/irs-pdf/f1099c.pdf

This is just a total scam.  Ignore them.  Block their calls.

    If they are bothering you,

This company is a debt collector (in my case, on behalf of Total Visa credit card). At first, when the calls began, it was regarding a legal matter and I was supposed to be sued. I explained that I had a medical issue that landed me in the hospital which caused my inability to pay, but I explained how I was willing to make arrangements at a later time. They continued to call every day until I finally told them to just take me to court because I didn't feel well and they were harassing me. Now, the same company continues to call but instead they're claiming that they'll be filing a 1099 c Form with the IRS which states that I received "unearned income" due to an unpaid debt.

In my case, it's regarding a Total Visa credit cardI had. After I paid $150 (I think it was) they gave me a $300 line of credit. Due to medical issues, I was unable to pay. Now, it's no longer a matter of taking me to court, but filing a 1099 c with the IRS claiming I received unearned income. These people won't quit calling. They will change their threats to best suit your situation. I legitimately owe Total Visa & I'll have to figure that out once I'm feeling better and back to work, but I'm not going through Jen/Gen Trans Management (or whatever their name is)! Good luck to you :)
