It is GenTran Management and they are known debt scammers.  CWG40 has posted their information.  I don't believe that they can legally issue a 1099C.  I believe that would have to actually come from Visa.  But if that were issued, first, no one could ever legally attempt to collect that debt because it would no longer be a debt.  Further, you would only be required to pay the taxes on in which in most cases would be 15% or less depending on deductions.

Legally they are required to do the following:

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it.  You are not obligated under the law to prove that you don’t owe or that it is paid.

Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes.  The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.

It seems that they have violated that part of the FDCPA which means that you can now sue them and make them pay you.  Using the information that CWG40 has posted:

You need to send them a certified, return receipt debt validation (by law they have to go back to the original creditor to prove you owe the debt), cease and desist calling, or "not me" letter (this will be the best money that you have ever invested).  Also send it first class mail in case no one will sign for it.  Make a notation of that fact at the bottom of the letter.  You also need to report them to the proper agencies to which I have provided links to.  Then you need to go out and get a consumer lawyer to sue them on a contingency basis (no money out of your pocket) and let them pay you for the harassment.  If everyone did these three things, these crooks would be bankrupt and we would all be the richer for it.  Use these web sites to find an attorney in your state that will probably take the case on a contingency basis (no money out of your pocket up front):  http://www.consumeradvocates.org/
    http://www.consumeradvocates.org/find-an-atto ... tates_value=All

First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/

Also file a complaint with your State Attorney General's office.

Thanks for putting in the time to provide us with this information. This is so helpful, not only for the current situation but for those I'm sure we'll run into in the future. I'm going to share this with some family members of mine that are being harassed as well. I don't know what company it is (or they are), but my aunts are elderly and really don't need this. Again, I really appreciate your help.

You are very welcome!  Read CWG40's post as he has named the DC and provided their address.  If they are harassing your family members, you can all sue them and make them pay you!

For a debt collector, filing a 1099 C (which I don't think is legal to begin with) would be counterproductive.  Once that form is filed, no one can ever try to collect that debt again since it is now considered income.  Even further, assuming you owed the debt, that would be a big win in your favor.  Most people only pay 15% or less of their income in taxes, so at 15% that would be a bargain.  However with deductions, it might even be lower than 15% so that would be even more of a bargain.

    Why Me?
A woman named Emily from Glen Tran or Gen Tran said I had a certain amount of days to properly report my income or they would have to send me a 1099 of some sort.  I tried to tell her she had the wrong person and that I had no income but she kept talking.  I finally said if she was going to keep talking over me I would hang up which I did.  I blocked her number.

GenTran, which has been discussed multiple times in this thread.  It really does pay to read all the other posts, because then you learn things that you really should know.

A Tonya Morales just called from Gen Tram Management stating that they were going to file a 1099C with the IRS for unearned income.  She stated to call them back to "reach a settlement ".  I have no idea what she is talking about.   Looking at other posts it appears obvious that this is a scam.

Just say, OK.  I have your number and I am going down to the local police station where I will be met by my lawyer.  They will call you to see how we can resolve this (after finding out what the issue is about).  Thank you for your patience in this matter.

What are you saying?  That person, who posted here last year, is reporting the call just like everyone else here.  Do you seriously believe that someone is going to meet you at the police station?  Pretty much your whole post makes no sense.  Or are you a representative of this scam outfit?
