    I received a call from this firm also. I thought it was also a collection tactic until i ended up getting served a subpena to appear in court. I ended up having to hire a criminal attorney because the charges brought against me weren't civil but criminal. My case ended up in the Harris County clerk of courts and while i was awarded a payment plan, I can never change the fact that now i have a check fraud charge on my record. It has caused me to lose my job & made it extremely difficult to find work. I wish i would have taken the opportunity to settle this out of court. Wasn't worth the hassle at all.

    I also agree with MD.. 12x6 is in for a surprise. I went to jail over this.. You people think its a game if you want too! I'm not gonna sit here and try and convince anyone on their own freedom but hey.. Look if you owe the money pay it back.. Its not free money, and you have to expect this to come back to you if you try to get away with not paying it.. Think about it! I don't wanna put my personal business out there but I went through it with this.. 12x6 should do some research prior to giving bad advise.. maybe its why your in the situation your in.. anyways good luck to all you guys.. Take my advise pay the money you rightfully owe!

    Yes, people can and WILL pay - if the debt is LEGITIMATE!  No proof of debt (debt validation letter as MANDATED by FDCPA) = no debt due!

    Who served you?  For what reason?  If you're going to try to scare people, better luck next time....

    If you ignored legitimate debt validation letters, then yes, your creditor (or collection agency) has the authority to have you served with a summons to court.  You should show up in court so that they do not win a judgment against you; even better would be to consult a lawyer.

I tell you some people will try and do anything to get out of not paying a bill.. I was raised better then that.. I toke it upon myself to actually do some research on the company that called me and the agency that I owed the money to and guess what, they are legit! Call who they tell you to call and check yourself.. Broke ass wack jobs talking to other people about min wage jobs and you on a site blogging on a company calling you to pay a bill your trying to run from??? What a hypocrite! The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

    •is seeking payment on a debt for a loan you do not recognize;
    •refuses to give you a mailing address or phone number;
    •asks you for personal financial or sensitive information; or
    •exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

    If you think that a caller may be a fake debt collector:

    •Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
    If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.•Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
    •Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft – charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
    •Contact your creditor. If the debt is legitimate – but you think the collector may not be – contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
    •Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
