- carlos aguilar| 2 repliesExcuse me, they called me from the same number saying that I must pay a hospital debt .... what did you do ???
- Tygerkat replies to carlos aguilarJust because someone SAYS you owe money doesn't mean you do. Request callers mail you proof of the debt along with proof they're legally entitled to collect said debt. Phone calls, faxes, and emails are NOT legal methods of debt notification.
- BigA replies to carlos aguilarWell, if they were smart then they would have made them follow the letter of the law.
It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified. If and when you get that letter you should immediately send that debt validation letter by certified, return receipt mail.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: https://www.consumerfinance.gov/
Also file complaints with the FTC: https://www.ftccomplaintassistant.gov/#crnt&panel1-1
Also file a complaint with your State Attorney General's office.

- BigA replies to Cuthroat| 1 replyI'm going to ignore your vulgarities even though you should be reported because I am curious about your post.
How do you know that? Are you speaking from experience? You actually owe this debt?Quote:This is a debt collector that has bought unpaid debts from a hospital and is trying to collect - Cuthroat replies to BigANever set foot in the state they are claiming I owe a debt to so no I don’t owe this debt. Law firms don’t make phone calls saying “I’m going to serve you papers in an hour but call me so we can arrange a better time” they just serve you.
Report me for vulgarity? Go for it if you want bud I don’t really care to be honest I’m stating my personal experience with this company who seems to have made this same call to several other today prior to today based on the OP.
And clearly they called you today too otherwise why are you searching the number on google? I find that odd.
