One of the largest debt buyer organizations in America  In 2005, Collect America owner Phillip Scott Lowery reportedly sold his operations for $350 MILLION to an organization called First Analysis Private Equity Fund IV, in collaboration with co-investor KRG Capital.

The Collect America system is comprised of approximately thirty franchisee’s across the country, with an attorney name on their door. Some of the attorneys such as Sam W. Streeter of Houston, have been dubbed ‘Rent-A-Lawyers’ due to their total lack of debt collection law and Fair Debt Collection Practices Act (FDCPA) experience.

Since the sale of the main organization, Denver Attorney Phillip Scott Lowery and his collectors that include attorneys David L. Michael and James R. Wolf have relocated to the Cherry Creek Drive address. Scott and wife Texie were rumored to have moved to Vail, CO, however he reportedly still is involved in the day to day operations through brother Arthur Todd Lowery.

CACV of Colorado, LLC. which stands for Collect America Collection Vehicle and CACH, LLC  are the debt purchasing arms of Collect America. Lowery and associates reportedly purchase these accounts for pennies on the dollar, then attempt to collect on the full value.  Collect America does place these accounts on credit bureau reports under the names CACV, CACH and Collect America. Under provisions of federal law, the Fair Credit Reporting Act (FCRA), they may NOT stay past the date of last activity as stated by the original creditor and the information and amounts reflected MUST be accurate, as stipulated by federal law.

The ONLY thing that can restart a ‘date of last activity’ is by YOU making a payment, Collect America cannot change it under any circumstances. You should always obtain copies of your credit reports directly from the credit bureaus to compare those dates. You have the right to dispute any debt buyer account found on your credit reports as “Not My Account” with the credit bureaus. Always keep copies of credit reports for reference.  If  a date of activity has been changed in violation of the Fair Credit Reporting Act,  you may be able to take legal actions against whomever in federal court for violating the law. This number is claiming to be Andrue PL (law firm) calling people i am indirectly related to.  seems this is drawing the line calling people that don't even have the same last name as me,

Going way to far by calling my neighbor that lives 7 houses down the street across the st.

This number has called numerous people trying to speak to me, they went so far as to call ex-in-laws that have not been around for almost 20 years.  I have reported them and will continue to report them.

I have gotten calls on my cell from a different number but this is the call back number they give. I have told them both times that it is not me they are looking for. I have had my cell number since 2004 and just because my name is Anne doesn't mean I am the only Anne in the country. If they are wanting my SS they aren't getting it. I am really getting upset about this.

I got a call on my cell phone asking to speak to me and used my first and last name. This person said it was in regard to a Eugene Rojit, who he said is a relative or acquaintance of mine. The person asked me to call him back to confirm the details. I do not have any debt in the collection stage and I have never heard of this Eugene person. I have no idea how they got my name and cell phone number. I'm going to ignore this one.

These people started calling me at work about someone with the same name as me and won't leave me alone.  If you don't believe they are crooks,check out their F rating at BBB.

My aged and sick mother died. We found a Leon against her home for about 4500.00 but 25.99 interest brought it to.  Over 10,000.00 she was never summoned to this date and never knew about it. What can we do to get it off? Helpless in arizona

I'm not sure how Arizona law works, but the best thing you can do is to get a lawyer that specializes in consumer law.  They have to prove that she was properly served, and if they can't the judgement should be thrown out.  However, once again you need to talk to a lawyer right away.  You may even have a valid FDCPA claim which would force them to pay all your attorney's fees.  If need be call your local BAR association up and ask them for a referral.  In most cases the initial consultation will be free or at a minimal cost.  This will certainly be well worth your time to pursue.
