- Kat| 3 repliesGot home today and had a court order taped on our door. This same company called us Monday and we ignored it because it did not sound legitimate. My husband called 866-846-8797 and they said there was nothing they could do for us now.
- the truthYou're a lying shill. A court order taped to your door? That doesn't even make sense. You're just trying to baffle people with BS and scare them into paying your fraudulent company. We know your kind here. You have a distinctive odor, and you fool no one.
- MJG replies to KatCourt orders are hand delivered by a marshal or someone appointed by the court - NOT taped to a door. I suggest you contact your local court to check on this. I call BULL on this one.
- TSTEXGIRL| 5 repliesNope no nada, this is just pure hit and miss. I thought that you can only be served in person as it is hand delivered to you. Besides, I believe this is a hookie pookie scam.
- Tyrann replies to Kat"It'd be funny if it weren't so pathetic.
[pause]
Oh, what the heck, I'll laugh anyway. HA HA HA HA HA HAA!"
- The Joker - Sir Bedevere replies to KatI have seen some really dumb versions of the fake "I was served papers" post here on 800notes. But this one takes the prize as the dumbest and most obviously fake.
Update your records, shills — a new low bar has been set for you to slither under. - ANonieMouse replies to TSTEXGIRL| 4 repliesActually, if this "court order" is a writ, summons, or other legal paper sent to the person required to respond, there IS something called "nail and mail" service available in some states.
From http://legal-dictionary.thefreedictionary.com/Service+of+Process :
"Some states permit service by affixing the summons and complaint to the entrance of the defendant's home or place of business and then mailing a copy of the papers to that individual at his last known address. This method is often called 'nail and mail' service."
While what was described in the first post in this thread sounds sleasy enough to me, I don't think we know enough yet to say that the person posting is a "shill." She may well be someone who did receive a call and who is now complaining about the practices used by the person at the number she posted. And many lay people would't know a "summons" from a "court order."
It would help if she posted the state in which she is located and more information about what was taped to the door, however. - TSTEXGIRL replies to ANonieMouseThat is true, I can just only relate to how they do that in Texas. I never came home to something nailed on my door as an act of service. They just hand delivered by Sheriff or court appointed processors in Dallas County. Thanks for the insight on this process!!
- Resident47 replies to ANonieMouseI would agree that we should give this room to breathe before we start sticking in our hatpins. Court rules vary enough across the country that we need to be careful about blanket statements.
If you look at the thread for the number given by the OP, the Shillometer needle starts wiggling again. It's reported to be a N'awlins debt collector which may be posing as a process server and making scary phone calls. - The Truth replies to ANonieMouse| 1 replyDig a little deeper and the fact that it's a scammer becomes apparent. Just search the phone number mentioned in the shill post (which is not the same as the one for this thread) and you get a word-for-word copy of the post from July 10. Somehow I doubt the exact same thing happened to two different people almost two months apart, both of whom came running to 800notes to complain about it. I stand by my Scam Sense on this one.
- Shill Alert| 2 repliesSo if YOU got home one day and found a "court order" (duct) taped to your door, would you be running to 800 notes to tell us all about it?
Shill. Easy. Case closed. - ANonieMouse replies to The Truth---> The Truth observed, "Just search the phone number mentioned in the shill post (which is not the same as the one for this thread)" <---
Good observation! That is indeed evidence that the original post is from a shill.
But we should still be careful about dispensing possibly erroneous legal advice and information. Otherwise, we risk our own credibility and could get into trouble. - FIGHTING BACK! replies to Shill Alert| 1 replyNot to mention, I'm CERTAIN the "court order" has the
NAME
ADDRESS
etc
of the company and they didn't bother to post that here... - ANonieMouse replies to FIGHTING BACK!---> FIGHTING BACK! said, "I'm CERTAIN the "court order" has the NAME ADDRESS etc of the company and they didn't bother to post that here..." <---
Not posting that information certainly makes the post here less reliable, but the name and address of the company on the court order may not be the same as the name and address of the debt collector -- especially if the company suing over the debt and/or the debt collector is a shell company, or if the debt collector is a third party that does not itself own the debt.
In that case, it may take a real court case with full discovery to determine who might have broken the debt collection laws or whether the owner of the debt is responsible. I have to admit that I don't know the answer to that question, and I don't have time to research it right now. And I couldn't give anything that could or should be relied upon as legal advice here. I'm ANonieMouse, and my advice here is worth everything you paid me for it. Just like many other things on the Internet. All I can do is try to point to sources that appear credible to me and refer to them in my posts.
Nevertheless, reports here that lack essential information are not helpful, even if they are posted by people who are not shills. - Eric Shackleford| 1 replythey called me left me a message saying there is charges against you blah blah .I had a feeling this was collections..
