They don't answer the phone by their name and they ask why you are calling. I told them in regard to their letter and to call my attorney.

- pmdrecieved an official looking letter threatening law suit if money is not paid to them within 10 days. our bank sent us to the state attorney General office and they sent us to the us postal inspector. no one had a hard and fast answer but all agreed it was probably fraud.

It is incumbent upon them under the law to prove that the debt exists and that you owe it, and (this is the important part) that they have the legal right to collect it. You are not obligated under the law to prove that you don’t owe or that it is paid.
Federal law (FDCPA) requires them to send you a letter (US MAIL ONLY) postmarked within 5 days of their first contact that contains their name, physical address, the creditor’s name, and the amount of the alleged debt. It also must contains “mini-Miranda” telling you that it is an attempt to collect a debt and that all information will be used for those purposes. The one other important thing that this letter must also have in it is that you have a right to dispute the debt within 30 days of receipt of the letter and if you do so, all collection activity must be stopped until the debt is verified.
First, you should make a complaint at this Federal Agency, and while there you should also read up on how debt collection is supposed to work as well as what your rights in this matter are: http://www.consumerfinance.gov/
Also file a complaint with your State Attorney General's office.

They never sent a 30 day , initial contact, letter. They send a 10 day litigation notice. Even then it wasn't in any type of security envelope. It's totally a scam. There has been no legal "serving" that should have come if this was legitimate. Don Sterling was part of trying to scam my parents nearly 2 years ago and finally left my parents alone. I guess he thinks we are all stupid. He needs to be shut down. Thank you for the information you posted.

The initial contact letter sent to my parents was not a 30 day letter it was a threat for litigation that gave a 10 day notice and was sent in a regular envelope and not a security envelope. They dance around the question of who the original creditor was and apparently have no real idea of what statute of limitations is or even means. FDCPA has been violated over and over and over again. They are preying on those who truly don't know what the rules are and that the consumer has rights. I worked as a data entry specialist many years ago in collections and am aware of FDCPA. These people are total frauds. Be smart demand they send you written documentation of the original creditor, date bill was incurred, bill amount and how to contact the original creditor. I'm sure they have bought debts to try to collect on however 2010 is way too far back to take to court. Look up FDCPA and read through it. It is very helpful to the consumer.
- CSame thing happened to me today, guys calls and says there is a formal complaint against you and we need to deliver court documents to you personally. They had an old address and I didn’t want to give him a new one. When I asked what it was about he gave me the 877 phone number to call.
